The guy on the phone said denied but the site says refused. We are now thinking that they just updated to the condition after the interview when we received the 221g. Technically, we were refused because of a missing document. We have since submitted that document but have never received confirmation that it was received. It is possible that once they review the NBI it can go back to AP or even issued. At least that is what we are hoping for now.

I am thinking the same ...  IF  ;)    (plus there are two more visas tied to this)

More patience.

My thinking now is it was refused under 221(g). We submitted the paperwork but it hasn’t been reviewed yet. They kept the passports and both the Filipino and American CO said that the only problem was the NBI AKA.

We are certainly hoping. I feel better today than I did yesterday. If we need a CR-1 that is fine. I just want to make sure we resolve what ever issue, if any, we have before filing.

Well, I feel much better today.  After searching all night and getting some information from friends here I found out that they don't do "Approved Pending Docs", they do "Denied Pending Docs" I think so that if the docs never show up, the status is denied.

So there is a possibility that it only shows refused because they haven't reviewed the NBI AKA yet.  I assumed it would stay at AP but I guess this makes sense too.

I will sit back and try to relax...

.. Exactly.  ;)

Rose just got the 2GO notice to pick up the passports.  Looks like we were denied.  There has been no explanation so far.

OK, this is getting weirder.  We are set to have the passports delivered to 2GO MOA and that is what is printed on the interview confirmation.  Rose's text from 2GO says they will deliver it today.  Is that normal?  Are they delivering to her house?  I thought they sent a text to say the passports will be at ready at MOA?

It really seems like there is something weird going on.

It gets weirder.  The 2GO was setup for pickup at MOA.  The text Rose got said "US visa del today".  When I talked to the embassy they said that they have no record of 2GO yet and that if the passports were being returned it would say "US passport del today".

They have escalated this at the embassy since it should go to 2GO MOA and they say it will be delivered.  There is something weird happening here.

She also said that we would receive an email as soon as the petition is refused explaining the decision.  We haven't seen anything at all.  She had my correct email address and we did receive the 221(g) only minutes after leaving the embassy after the interview.

The refusal was because I failed to disclose information on the petition.  It was an expunged arrest from 1990 that I forgot about.  It is my fault.  I didn't read that expunged arrests mattered when I filed.  I was not convicted.  It was for battery.

Now we need to see if another K-1 or CR-1 is the better route.  I feel like an a$$....

That's awful. :( I wish they noticed the issue sooner....would have saved some time at least. But don't let the mistake get to you...you'll get through this. Keep the faith alive.

Yes.  This is on me.  I will put together a much better package this time.  We are just determining if a K-1 or CR-1 should be used this time around.  I was expunged in 1995 I think.  I should be able to find court documents and refile.
