Can I file my N400 without my GC

Like I mentioned if you have a copy of your old expired green card you can still use those. They have everything in the system and will like to just verify your “residency since” date which is the date that makes you eligible to kick start your application. You can also send a copy of your approved I-751 as well.

Adjustment of Status From F-1 Visa.

8/14/2014: Mailed AOS package: I-130, I-485, I-765.

8/18/2014: Accepted in Chicago. Transferred to Nebraska Service Center.

8/21/2014: Received NOA 1. I-130, I-485, I-765 in mail.

8/25/2014: Received biometrics in mail. Scheduled for 9/8/2014

9/24/2014: EAD approved. 36 Days!

10/01/2014: EAD mailed.

10/03/2014: Received EAD card.

10/14/2014: I-485 moved to testing and interview.

1/28/2015: Interview scheduled for 3/4/2015.

1/31/2015: Received interview notice.

3/4/2015: Interview completed and APPROVED!

3/5/2015: Welcome notice mailed and I-130 Approved.

3/10/2015: Welcome notice and I-130 approval notice received.

3/12/2015: Green card mailed.

3/14/2015: Green card delivered.

Removal of Conditions: 

12/14/2016: Mailed I-751.

12/19/2016: NOA issued.

01/26/2017: Biometrics.

05/03/2018: I-751 transfered to NBC.

02/27/2019: Joint I-751/N-400 Interview.

05/14/2019: I-751 APPROVED.

Naturalization:

12/02/2017: Mailed N 400 to Phoenix, AZ Lockbox. (I-751 still pending)

12/05/2017: Package delivered in Phoenix, AZ. Transferred to Harrisonburg Processing Center.

12/07/2017: Notice of action issued. (IOE)

12/26/2017: Biometrics.

01/23/2019: Interview Scheduled for 2/27/2019.

02/27/2019: Joint I-751/N-400 interview. N-400 recommended for approval.

05/16/2019: N-400 APPROVED! Placed in line for oath ceremony.

05/17/2019: Oath ceremony notice mailed.

06/12/2019: Swearing in Ceremony! Finally a U.S. citizen!

That's not true at all, where are you getting this information? You simply submit a copy of your expired GC and valid 1yr extension letter. Nowhere on the instructions for N400 does it say that you need a valid GC to apply for N400.

Just file online, it's a much simplified process. Save yourself a trip to the post office. All you have to do is scan supporting documents, and then bring the originals/hard copies to your interview. https://www.uscis.gov/n-400

The same  thing happened to me. So I filed with the copy of my conditional GC, then when my 10 year card arrived four weeks later I copied that and uploaded it. I also uploaded the approval letter before the 10 year card arrived. I didn't want to delay my application and my card took a month to arrive. Also, I did not upload my tax returns as we had not done them by then, but as soon as we get  those back they will also be uploaded. 

 

So yes, you can do that. You wont have your bio metrics appointment  to around until 3 weeks after you apply and then its security checks, so you have time to upload your 10 year card at a later date. You can upload documents and add after applying for N400. This applies if you are thinking of applying online. I am not sure about paper filing. Good luck! :)

Online they require a copy of the front and back of the conditional/permanent card uploaded with the application.

I filed N400 while i751 was pending. Sent a copy of my two year card and there was no issue whatsoever.

We filed my wife's N400 as soon as she became eligible (look at my timeline). We still haven't received an approval on I-751, but our biometrics for N400 is done, now waiting for an interview. There are plenty of people on here who received their certificate of naturalization without ever receiving a 10yr GC.

 

By the way, by no means should you ever mail your valid or expired 2yr GC under any circumstances. Always mail or scan copy of originals. The only time you let go of your GC is at the N400 interview.  Even when you go for an info-stamp, they cut a corner and return your expired GC. 

There are times you do need to relinquish the green card. My expired one got shredded at my local office when I went to get my I-551 stamp. I also had to send my current 10 year GC back to CSC last week because of misprints.

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

I am in the same situation where I would like to file N400 (given that my I751 was approved) but the 10-year GC hasn't arrived yet. My 2-year GC and the extension letter were taken away by the USCIS officer when I came for the I551 stamp.

I have filled out everything online but haven't submitted yet.

I have everything including my I-55 stamp in my passport. My 2 years GC is still with me and my one year extension letter too .
