Is filling a divorce waiver hard?

Hi, I am a November 2017 i-751filler.

 

I have been separated with my husband over a year after him accusing me cheating on him with my gay coworker. (In fact he was cheating on me and currently living with her)

 

He said he was going to wait for me to get a green card then get divorced but he's keep changing words and trying to control me and threatening me so I am just tired of it.

 

I want to get divorced and file a divorce waiver. I talked to a lawyer and he said unless I was going to get divorced 2-3 years obtaining the green card it was the only choice for me.

And also I need to notify USCIS that I am proceeding divorce and send them evidence of relationship. 

Is it correct?

 

And how hard is to get approved with a waiver? I am thinking about no-fault divorce since I don't want any complexity with him.

But I will get letters from his parents and him that this marriage wasn't fraud.

you cannot stay together for the purpose of immigration benefit. that is fraud.

 

There is this bright path right in front of you, be honest, get divorced and file i751 on your own.

Yeah the marriage was legit. I met him at work and we came here together after him getting out from army.

It was okay until he turned to totally different person I used to know.

 

I do have a lot of pictures with him and his family is on my side so I can ask them for letters. We have a house together. Will sell it soon but I need to sign to sell so that can be a proof too I guess. I also have military dependent card under his sponsor when he was in military. I was afraid of getting kicked out because I have no connection in my country and I am not willing to go back there. And I tried to work with him on the marriage but he ended up with that girl he was cheating on me with so I am going to say bye to this marriage and get the green card with waiver!

Sounds like you have some good proofs.

 

Try to collect as much as you can, mainly financial co-mingling and proofs showing you lived together. You should be alright.
