knowing overstay is forgiven once married i did not see a reason to mention it

i never had left the usa since 2009

and given that question  a raised on the first interview and cleared as 2 years conditional was approved

makes me wonder

according to the uscis supervisor it appears i might have two A Numbers

but she was not able to provide any information

Well it always helps when you are asking for information about an issue if you are forthright with your backstory so people can better assist you. Also you do not have a timeline so we are kinda left guessing as to what is going.

i went on a b-2 visa had h2b and j1 in the past as well

all extended through 2005-2009

Just for clarification.... are you saying you had 3 different types of visas, AND all three had approved extensions....AND all visa approvals and extension approvals happened within a 4 year period?

Do you have a very common first and last name? Maybe 2 different files have been combined inappropriately within your current case.

Did you have a 2yr home residency requirement on your j-1. I assume this isn't an issue as they granted an H visa and it was a short stay so they don't usually add the requirement... but could(?) complicate things if you did and didn't fulfil it...

Sounds like he had H2B status not a visa.

Do a FOIA request for your entire file for your A#.

If you can get hold of the other A#, file a seperate request for that file too.

https://www.uscis.gov/about-us/freedom-information-and-privacy-act-foia/how-file-foia-privacy-act-request/how-file-foiapa-request

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks).
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE...
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time.
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case.
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied]

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) ....

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

2024: FML. Seriously. I'm done.

You obviously have a mess created by either J1 or H2B and when you filed for green card, they might’ve mistakenly created a whole new A# rather than add to the old one leaving the J1 and H2B left to rot over the years. I wont be surprised if you had a bunch of letters showing up to old address asking you to leave due to expired H2B or J1.

Hopefully this is their mistake for not having everything under 1 file and a good lawyer can work backwards to get them to correct their errors one at a time

Definitely recommend to do the FOIA request for your file----best to have all the information you can get in your hands.

Hi Guys,

First of all Thank you for replying.

No criminal recored in general,US or international.

got married 03/10/13

filed I 130 & I 485 I think April or May 2013

interview was first scheduled to September and we had to reschedule so Feb 15th...the interview went fine but the IOA said he has a red flag and asked if i ever got deported or served with one
i applied no,it took 6 month but i got my GC on July 2015

my ex wife and i broke up around Feb 2017 but filed for divorce in may 2017

I filed my I 751 with a waiver,Biometric and extension went fine...  i just got my divorce decry in Dec 2017 didn't get RFE to give them that

Went today for the infopass ,got that info.

So at your AOS interview you already found out that there might two A# under your name or at least had deportation orders on your file? That would've made me so nervous and I would've tried everything I could back then to have that fixed. When it comes to immigration things like that always seem to backfire if you don't take care of it immediately. I would've had sleepless nights over this...even if it eventually got approved.

I literally went twice to an infopass to have an IO check my file that everything was in order after they had accidentally put my AOS file to be sent back to Missouri to have it denied for a no-show after I rescheduled my Greencard interview. Better safe than sorry... this stuff can literally ruin your life...
