 Hi everyone ! 

 

I had my interview at US Consulate in Sydney for k1 visa application. The interview went well. But I lack one of the requirements the W2 of both my petitioner and the co-sponsor which is his Mom. So the CO was asking for it. 

 

My fiance has  just started forex trading not long enough and his mom is a landlord so self-employed as well. An Immigration Attorney helped prepared the form i-134  and other relevant documents so I assumed that these was prepared well.  

 

I got confused  about w2, and I asked CO if what is W2 but just told me that those who are paying taxes have that. And in my mind “ how can my petitioner pay tax when he has zero income stated on the  his form i-134?  “

 

So I came to know now  that W2  is a form that an employer must send to an employee and the IRS at the end of the year. W-2 reports an employee’s annual wages and the amount of taxes withheld from his/her paycheck. 

 

Even self-employed such having a business of course should pay taxes too but W-2 are those for  employed  who receives wages from employer.  

 

Do they need to provide W2  the fact that they are self-employed which  reflected on the 

form i-134 under employment information ?  

 

Can someone please enlightened me about this matter? I might be wrong .

A W-2 is only issued to an employee of a company. Self-employed individuals will not get one.

 

I'm not sure why the CO said to provide one as they cannot provide what they were never issued. However, I'm assuming the sponsors did not provide sufficient evidence of their self-employment income. What evidence did they provide? Did they provide tax transcripts from the IRS (https://www.irs.gov/individuals/get-transcript), or just a 1040? Any tax return schedules?

Hi Geowrian thanks for your response.. yup co-sponsor had provided the tax transcripts while petitioner had none as he is below minimum income , so did not file tax at all.
