Name format change in passport afte tourist visa issue

Hi, I have tourist visa issued on my old passport in which the name appears as follows,

 

OLD PASSPORT (Visa issued under this name)

======================

LAST NAME: <BLANK>

GIVEN NAME: ZAINAB BAI

 

I now have a new passport as my old passport expired and the name appears as follows,

 

NEW PASSPORT

======================

LAST NAME: BANSWADAWALA

GIVEN NAME: ZAINAB

 

Please advise if I need to do anything or I can travel without doing anything by carrying both my passports together (This is my first time traveling to US). I am an Indian citizen.

You don’t technically have to get a new visa, but you  should as recommended by DoS in order to avoid potential problems on entry.  You could try bringing a name change certificate along with both passports if you don’t to try minimize hassles on entry I guess, but a new visa is preferable.

 

If your name has legally changed through marriage, divorce, or a court ordered name change, you will need to obtain a new passport.  Once you have a new passport, the Department of State recommends that you apply for a new U.S. visa to make it easier for you to travel to and from the United States.

Looks like more than a surname change after marriage/divorce. The first name change through a deed poll likely requires a new visa appl.

Thank you for your reply and thanks to other who replied. The name change is neither due to marriage or divorce, nor due to any court ordered change.. It is just a change in the format with last name added. The old passport was made a while ago and didn't have name in proper format.

Then I agree, get a new visa as you don’t have any legal proof to show at the border that it’s the same person.

Huh?  It looks a bit more than a change in format to me. Your given name is different, and a new last name

 

You will need to officially document the name change format, then apply for a new visa.

Thanks for all ur replies. I did as advised on this forum and also as advised by the US Consulate and went ahead and applied for a new visa. I qualified for interview waiver and submitted the documents.

 

They didn’t issue the visa on the new passport and asked us to submit more documentation for name change plus birth certificate.  Again we submitted this documents but they called me for interview.

 

I went for the interview and was grilled for 30 minutes on why I went to Iraq.. (Iraq has some pilgrimage sites for us). My travel to Iraq was mentioned on both occassions while filling the DS160 form. Finally they refused visa and also cancelled my original visa under section 214(B). 

 

Don’t know what to do now apart from applying for visa again. I am out of visa fees twice. My intent to travel is and always will be non-immigrant. All this has caused only stress and disappointment in spite of going by the book and as advised...

 

PS: If you do wonder why I changed my name in the passport. That’s because I b elong to a small town in India and my parents aren’t educated much so when I was a child, my father applied for my passport with my nick name without worrying about anything. Getting a visa to Middle East or other countries was never a problem. Now that my original passport had expired and I am an adult, I went ahead and applied for a passport with my proper documented name and that is the reason for my name change in the passport. I have proper proof of this name change as well that is required as per Indian laws.

Technically, you can try again, up to you. But likely lead to another denial.. the next CO is unlikely to overrule their colleague. 

 

There are plenty other nations to travel to.. what about a US visa denial could be cause for stress or disappointment?  Ideally, you should have ties to India to begin with (a requirement for a b2 visa).

My sister is in US for the last 5 years and she is about to deliver her child so wanted to go help her. I wouldn’t worry or feel disappointed just for the sake of vacation!

Hm, if you said that to the CO that could have been another reason for refusal too. Childcare, even by relatives, is not permitted on a tourist visa.

 

Your denial reason however is immigrant intent, which means you do not show sufficient ties to home.

Besides lack of sufficient ties to home, another reason for a 214b could be an i-130 petition if you have one pending (assuming USC sister)

Sister will be fine on her own with her husband and newborn. Plenty of women deliver in the States and have no family around. There’s also night doula if she needs assistance - $$$ but she handles the baby at night so mom can sleep.

This forum is not for providing moral advising or how to handle other situation so please stick to discussing visa issues. The problem is I already had a tourist visa. My passport expired. I simply followed all legal procedures to have my legal documented name on my new passport and then apply for a new visa as advised.

Well, this CO overruled his/her colleague to cancel the visa that was approved earlier by a colleague, right...
