Hey there everyone,

I am a little curious about the time frame for hearing back about I-130 approval. My spouse visa I-130 package arrived January 4, 2018. It is now almost May and I have not heard anything from them besides the initial email and letter confirming the receipt number. My case status online has not been updated since the Receipt Number saying case was received. I dont even know where or if it is being processed or if its in back log and sent to another location from the original USCIS Chicago Lockbox.

 

I did some research and saw the basic I-130 package for approval  can take 3-7 months. After, it will take another 3-6 months for the additional documentation, interview, and the visa to arrive. I have also found a link that you can check processing times on the USCIS website. But, I do not know the field office or field center and when checked it has not been updated since 2017. How does the processing work? Does it take 3-6 months to be notified of the location and receive a case number? Do you learn this information at the first approval or when they seek additional information? I am getting a little worried. 

 

Also, I found out my wife is now 10 weeks pregnant. Do I need to inform the USCIS people before the birth if the birth is outside the country? I was doing research on the Japan USA embassy website and they say I must bring the new born within 3 months and the baby will be a dual citizenship until the age of 22. I just do not want a mistake. We plan to move back to USA next year.

When you received your first notification, your receipt number would indicate the service centre. Check the first 3 letters. You can expect absolute silence from USCIS for about 6 months after filing. After your petition is approved, it then goes to the National Visa Centre, and that stage can take around 3 months.

Thank you for the information. My first 3 letters are YSC.  So potomac service center...

That's the initial I-130 timeline. USCIS (under DHS) only posts their timelines. NVC and the embassies are part of the DOS.

Well, I may be in bad luck then.... I don't have the luxury of 15 months time. I will hope that I receive the first part before August.

You can file for Consular Report of Birth Abroad for the baby when he/she is born.  If you have ever lived in the States for 5 years, 2 of which over the age of 14, you can transmit citizenship to your child.  Then, there will be no need to file for immigration for the child.  You should check the process out for Japan.

Well, I was at Potomac when I filed last August and I got my NOA2 in 5.5 months. Processing times on the website are usually on the conservative side. For relatively straight forward cases, I do believe 6 months is a good average for NOA2. Of course there is a chance that the service centre might slow down massively in the weeks or months to come, so I would say just be prepared for about 12-14 months to get visa in hand.

My i130 petition was approved at the Texas Service Centre after 11months

I was recently approved at ysc potomac. it takes 6-7months to be approved
