AOS interview successful, but waiting for FBI name check

Hey Laura and Mark I was just wondering about you two. I can't believe you are stuck in here also! Can you remember when we thought we were at the end of this ha! ha!

Hello Elsa and Ali...yes, it was a long time ago we were stuck together in Nebraska. Much has happened since those days and still we wait...and wait...

At least during this wait, we are together. :)

I am not sure the burearacracy will ever stop. It just keeps getting deeper and deeper...

Nevertheless...we are dancing :dance::dance:

March 1 2004: I-129F mailed to Nebraska

March 2 2004: NOA1

July 7 2004: RFE in snail mail- want original signature on Laura's G-325

July 23, 2004: APPROVED online (143 days) WOOOOHOOOO!!

Sep 30-2004 - Interview in Vancouver. Visa Approved!

Oct 19, 2004 - Arrive in US through North Portal, North Dakota

Oct 20, 2004 - Home in Michigan at last!!! YEEEHAAAA

Nov. 18, 2004 - Wedding Day :)

Jan 25, 2005 Mailed AOS, AP off to Chicago

Feb 2, 2005 Received in mail NOA's dated Jan 31

Feb 23, 2005 Biometrics appt in Grand Rapids. All went well!!

March 10, 2005 Bobby's AP & Laura's AP are Approved!!!!

May 23, 2005 Received AOS Interview Date from Detroit...August 22, 2005

July 6, 2005 Leaving for Negril Jamaica on our honeymoon MMMMMM

August 22, 2005 AOS APPROVED subject to background check.

March 15, 2007 STILL WAITING...File another I 131 Travel App

April 5, 2007 Infopass appt in Detroit. Learned FBI approved name check March 30, 2007

May 1 2007 Contact Congressional liason office, who contact USCIS

May 8, 2007 USCIS issues letter to update fingerprints on May 23

May 16, 2007 Second I 131 approved

May 23, 2007 Fingerprints updated

June 28, 2007 Finally receive Permanent Resident Card !!

well at least they knocked the dust off ur file to have u come get some more fingerprints done. so thats a good thing.

my husbands fingerprints have been expired for a year now and they havent requested any more from him. sometimes i wonder if they have lost his file and thats why there has been nothing more done since the interview.

also i think i asked my lawyer why they would request new fingerprints since fingerprints never change and i believe she said because u could have commited a crime since the first set and newer ones are more accurate. still doesnt make sence cuz the old ones im sure are still on file.

oh well.

We had our interview today...were approved...pending name check from FBI. Not sure why it would get stuck in

this area given my husband is from New Zealand and has a common last name. So waiting to see what happens now.

We did apply for AP (which has been approved) and EAD at the same time...at least if he gets the EAD he can begin to work...he is starting to go house crazy..lol

Best of luck to all those out there in this waiting limbo.

However, one quick question, what do i have to do to renew my work visa? Is it just one easy form and lots of hard cash? Can it be done online?

around 100-120 days prior to the expiration of your current one, either send out the new package (see I-765) or you can e-file it. note that the USCIS recommends renewing 6 months prior to expiration, but anecdotal evidence shows 100 days or so should be sufficient.

E-filing the EAD has been discussed in the other forum.

General concensus is that it's better to paper file. USCIS still requires two photos, plus copies of your old EAD, etc. There have been reports of e-filed EAD renewals seemingly delayed while the paper portions of the petition 'catch up' to the e-filed part.

It is the common name that will likely delay things. The more common the name, the more hits to follow up.

sorry to be horribly off topic in a on-topic kinda way, but since im waiting for a namecheck, i would pick option C9 for my EAD renewal right??? Since my status adjustment application is still technically pending... And then it would be mailed to my local office, detroit???

Jeez, so long without forms i forget how it all works.......

..or fails to work i should say,

And on the day i noticed my case got touched for the first time since xmas, ill prepare my next 180 dollar cheque.

Yes you still file the C9 category. But you mail the petition to the Chicago Lockbox address.

Are you saying you got a touch? That's good - it might mean something and it might not. How long until your EAD expires?

Yep i got touched on march the 17th, but it was only someone looking for just the right sized file to prop up their wobbly desk. And my visa runs out at the end of june, yes i know im a idiot, i meant to renew in early march but i got caught up in that thing called real life that immigration people believe we dont have.

Anyway why do we file in chicago when it says file at your local office? Or does chicago send it too your local office? If not which processing times do we check?? Aghhh i forgot about this hopeless feeling......

Filed for I-485 AOS 7-12-04

File went to FBI for Name Check on 10-08-2004

AOS interview 2-16-2006

Told that AOS approved "Pending Name Check"

Refiled for EAD 12-12-2006

EAD approved 3-04-2007

I-131-AP filed 2-18-2007

I have written both Senators of my state with no luck.

I have written my district congressman with no luck.

They all say it is out of their hands.

I even wrote GW Bush a letter asking for help , but got no reply.
