AOS interview successful, but waiting for FBI name check

I was wondering whose name is going to be checked? The immigrant, the USC or both?

immigrant only. this is not a petition by the spouse, this is an application by the beneficiary.

Hi.....since we are still patiently waiting...(almost our two year wedding anniversary!!)

does anyone know if local offices have a "local ombudsman" in each city before writing to the ombudsman

in Washington...we want to try every avenue of course. Thanks!

We had interview Sept 2006 and got touched only once Oct 2006 and touched again yesterday after almost 5 months. IS THIS A GOOD SIGN????

I would say it's a very good thing. we had almost the exact same thing happen. No touches since October and then we started getting touches last week, got the welcome letter and yesterday got the word that the GC is being produce and will be here in 30 days or less.

I really hope in means something as well!

Anyone in this thread thinking of a WOM, writ of Mandamus? I read the document that rebeccajo posted the link to in another thread. http://www.uscis.gov/portal/site/uscis/men...00045f3d6a1RCRD

It is disturbing that even a WOM will not be reason enough to push the USCIS to get the FBI to expedite the check. And also they have very strict criteria for expediting. WOM cases are expensive.

I spoke to my lawyer who advised that a WOM is a big risk. It costs a lot ($4k) and these days he says that it is hit or miss. USCIS can take as long as they want to make a decision. So the WOM gets you nowhere.

I spoke to AILF about the interim EAD situation. They have about 20 other cases similar to mine and say there are many more out there but people are hesitant to be named in a lawsuit. I think no one in these boards is in our situation but I ask that if you are OR if you know someone in a similar situation PLEASE at least let AILF know so they have a sense of how widespread the issue is. I really want there to be lawsuit so that this nonsense will not happen to more people.

Temporary EAD given for 1 month ONLY b/c of Infopass appt: 5/1/2006

Went back to renew EAD through Infopass: EAD card was not given "due to reasons we can't disclose"

5/3/2007: Confirmation that EAD is delayed due to background checks. (started to use the senator, ombudsman and was just a royal pain in the neck)

5/30/2007: EAD production ordered (after over 400 days of waiting!!! woo hoo!)

AOS Interview: 5/12/2008!!! FINALLLYYYYYYYYYYYYYYYYYYY!!!!!!!!!!!!!!!!!!!!!!

7/29/2008: card production ordered...918 days..can't wait to see that card!

we are no longer considering WOM as a course fo action. We are focusing on the lobbying efforts instead. Immigration is set to change this year, and I want to be a part of who its changed, even if its a very small part. As far as discussions on whether to or not, you may want to check out the Yahoo group. There is much discussion about it now

I dont know what has happened in your case to delay your EAD so severely, but I certainly hope you can get some resolution.

All of you are well ahead of me. I'm going to join the yahoo group. My laywer sometimes seems a bit behind the curve but I've learned to do my own research.

Our delay is the namecheck or security issue but we don't know why they have created this as an issue for the EAD. We expected it for AOS but not for the EAD.

My lawyer was very blunt and said basically we're mired in a black hole and there is no way out. I believe this too.

oh I think he can do better for you! I have never seen a EAD/namecheck corrolation. You can try a few of the things below ( i would suggest confirming your prints received and sending a letter to the Immigration Assistance Center.
