i think it's a matter of poor terminology on the part of the interviewer. when we left our interview, the officer said to us, "I'm going to recommend approval for your application, pending FBI name check." so, we heard, "you're approved!" sadly, that isn't truly the case...as the decision does indeed hinge upon the name clearance from the FBI.

Traditions Way, that's not the instructions for the form I-751, but upon reading the form again I think I see what made me think sending the form would be pointless. Item #8 says the facility is only responsible for issuing cards after receiving an approved application from the INS office (very old form apparently) servicing your area.

We don't know the chain of command with these offices. For instance, in our case we were interviewed in Pittsburgh. Anecdotally to me it seems that our Adjudicating Officer will eventually (after receiving the clearance) sign off on my husband's petition and then pass it off to his supervisor (probably someone in Pittsburgh). The next steps are unclear to me. Does this approved petition then go on to our Service Center (Vermont) and Vermont orders the card to be printed? This sort of makes sense to me when you think about all the e-mails one gets once approval is issued.

If this is the case, then perhaps sending this form would trigger somebody at Vermont to inquire at Pittsburgh what is happening with the file. But maybe not. As I said we don't know the chain of command. Some clerk in Vermont might be the only person to tick the box that the office is not responsible - or then again it might get forwarded to a supervisor who would follow up on why the case is taking so long.

Makes me wonder if it would do no harm to send the form out.......

To all who may be wondering...... We are still waiting for our Namecheck!

Had to re-apply for our EAD, another $180.00 down the immigration hole. Gonna have to apply for AP in a month or so. They are killing me.

News article worth reading. It discusses possible discrimination to muslims applying for citizenship (i don't buy it), but the overall theme is the problem with FBI clearances and what people are doing about it.

http://www.denverpost.com/movies/ci_4813326

Zuhair Mahd of Denver made all the right moves to become a U.S. citizen after escaping poverty and rejection as a blind Palestinian-refugee teenager in Jordan.

He found a banker to buy him a ticket to Boston. He excelled in U.S. schools. He pioneered Arabic text-to-speech software and worked for IBM, honing skills that recruiters for the CIA and other agencies covet for the war on terrorism.

Then he applied for citizenship, passed the tests and waited for an FBI background check.

And waited. And waited.

After waiting for two years, Mahd, 33, sued the FBI.

Now his case is pending in federal court along with hundreds of other lawsuits nationwide by Muslims who made the grade to become citizens but have been delayed while waiting for FBI checks for up to five years. Applicants for U.S. citizenship come from many nations and cultures, but most of the lawsuits filed recently in Colorado involve Muslim immigrants.

donnaal and waiting, both of those things sound like positive news to me.

donnaal, that cryptic message sounds like the 'new' message CSC transferrees started getting about 6 weeks ago right before they got their greencards.

waiting, if you look at robinlakes above post, you will see that recent touches netted her husband his card.

I hope we get good news for both of you.

Thank you rebeccajo, but I am not feeling very optimistic about it. I belive the touch on 12/22/2006 was for the address change and the inquiry we filed because the very next day, we recieved the dreaded "check back in 6 months letter". However, the 01/03/07 touch is very puzzeling.

thanks to all who participated in the call last night! I hope it was informative and worth your time. For me, learning about all the proposed legislation scared me straight to AFU! And what's better about it is again, the power in numbers as well as the doors that open as being part of a group. The attorney consult I had as a result was invaluable!
