AOS interview successful, but waiting for FBI name check

Just a quick question - if your name check takes so long that your 2 year anniversary has passed, do they issue a 10 year green card?

Our 2 year anniversary has already passed and we recently went to an infopass appointment to check on the pending name check. When I asked in regards to whether or not we would receive the 10 year green card once the name check has cleared the officer told me it all depends on the officer handling your case. Some issue the 10 year and others still issue the 2 year conditional. Unfortunately with us the officer who interviewed us has moved out of state so we don't even know who is handling our case . I hope it is someone nice!

yes, i do recall one other member who did *not* receive the 10 year card, cited being up to the AO's discretion.

ok, i am gonna try this again. I have spoken to a well-respected immigration attorney, it really cleared up many questions I had and put me on a track to CYA should I need to pursue WOM. He did confirm my statement if you go past 6 months, you are most likely in it for a long (er) haul. there is no reason why these 1% past 6 months need to collect dust. Guys help yourselves, get information. I am not quite sure again, if those are accepting the MIS-NOMER of *approved pending namecheck*. you are not approved until you get a welcome letter, stamp, or greencard in hand. period. help yourselves, use the resources available to you! we still have 2 laywers available for an auction with no bids.

They said the same thing to my wife and I. I called the local FBI office, to find out what the hell was taking them so long. They gave me a number to the office in washington that takes care of these checks. Called them, they looked and said it was done months ago and sent back to INS. Not sure who was fibbing and who was telling the truth.

When dealing with the government, treat what they say like car salesmen. Document all you can, who you talked to, and who said what at what time. We waited about a year and a half but received her 10 yr green card after riding herd on the INS, FBI, and the Congressmens office. They were a little help, gave me the name and number of the person in charge of our local ins office, otherweise just part of the system i.e. thats the way INS works or you have to wait for the process, type of nonsense.

If what they say sounds like bullshit, call them on it. They work for you remember.

The FBI does not release any information over the phone, mail, email or fax any longer. They will only respond to their clients (ie : USCIS, etc). You CAN however request your own FBI Identification Record

you cannot call to book it, but you can through the website. Best if the beneficiary attends, as it is their application. I am not even sure if they can tell you anything if you are the spouse.

Sorry maybe i should change my profile, my fiance/now wife set it up ages ago, but me the male beneficiary uses it. So yeah, im the potential green card holder. So would it be ok to go by myself, will be so much easier to arrange without either of us trying to scrounge time off work.

What really gets me is that fed-ex managed to get name and driving record checks from 3 different countries within the space of 5 days when they hired me. Ahhh the power of money.....

Looks like my status on this never got updated...

We got thru the name check about 1 month after the interview. We had gone in for an infopass appt to yell about no EAD or AP yet, and we sat around for 2 hours while they tried to find our docs. Then they told us to come back 2 days later. We came back 2 days later, and sat around for an hour, and then they gave us the good news we were approved. Got the stamp, and left happy.

Doodles, did you go for Infopass? If you did I missed your report on that. Have you been re-fingerprinted? I see your biometrics are 16 months old, which means your first set of prints are now stale.
