AOS interview successful, but waiting for FBI name check

Hi,

for all those "approved pending checks" - did you receive a white paper at the end of the review explaining security checks are still pending and if you don't hear in 90 days you can email them to inquire? The letter also states "we will monitor the status of your case on a weekly basis and immediately notify you when the security checks are completed and an appt can be scheduled regarding your pending application." Does this mean we'll have to interview again? I could of sworn our AO said that we'll just be notified by mail when it's approved... I should have read this more carefully at the end of the interview last week and clarified with the AO.... :huh:

We received the same letter, our AO said she will contact us once the "administrative checks were completed".

I used AP to enter the US back in the beginning of November. The officer at the port of entry said something i found quite interesting after he stamped the new I-94 i filled out before landing. He said " I am giving you one year, if your AOS is not finalized by then, you should go to your local DO and find out what is going on"

Does that mean if i dont get a decision by the expiration date of this new I-94, that I will be considered out of status? even though my AOS is pending?

Off the cuff I'd say he meant you need to follow up on your case. Nothing more.

My understanding is you are considered 'an applicant to adjust status'. You aren't here without inspection, but you have no immigrant designation either. You are an applicant to adjust. A person in limbo.

Called the 800 number yesterday to update the address, also made an inquiry. Was told will get a response in 45 days from local office, the standard line. Been in name check since February 2006, interviewed in June 2006 and have not heard anything since.

I was told the exact same thing when made an inquiry.It's been 31 days since I called 1800...still nothing.I've been in a name check since January 2006,interviewed July 2006.Last online update was in June 2006 stating that they received my RFE in March 2006.Nobody even bothered to update my case after interview.Right after New Years I'm going to start acting because I've had enough of it.My plan is to contact my Senator and Congresman,next step will be USCIS Ombudsman and the last resort will be WOM.I know that people have been waiting years for name check to clear,but to me it just doesn,t feel right just sit and wait.

02/2009 - File to lift conditions

12/14/2006--- Mailed EAD App.

01/20/2007--- Biometrics

02/09/2005-------Sent in request to Congressional office for assistance with expediting EAD.

02/13/2007 -------- EAD Approved!

02/26/2007 - ------EAD received

Removal of Conditions:

05/12/2009 -- Overnighted application by USPS express mail (VSC).

05/14/2009 -- Green Card expired.

05/23/2009 --- Check cleared bank.

05/26/2009 -- Received NOA (NOA date May 15, 2009, guess they aren't deporting me).

05/29/2009- Biometrics Notice date

06/01/2009- Received Biometrics Letter

06/18/2009 - Biometrics

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.

Supposedly yes. The only benefit of the wait.

lal_brandow is more observant than me sometimes though and I believe she recalls cases where that has not happened.

Our 2 year anniversary has already passed and we recently went to an infopass appointment to check on the pending name check. When I asked in regards to whether or not we would receive the 10 year green card once the name check has cleared the officer told me it all depends on the officer handling your case. Some issue the 10 year and others still issue the 2 year conditional. Unfortunately with us the officer who interviewed us has moved out of state so we don't even know who is handling our case :blink: . I hope it is someone nice!

Well, all the petitions we filed were touched today for the first time since we had our interview in mid June 2006, including the I-765 and the I-131 that have already been approved 8 months ago. Now, I dont know if this is because the change of addrss and the inquiry request a couple of days ago or something else. Dont know if I should be getting excited or not but its something.

Yes we have contacted them but unfortunately they are unable to help us. All they have been able to do is prove that the FBI received the name check request.
