People who are adjusting status from a tourist visa, DO require a waiver if they committed a crime that requires a waiver, same as you would need for a K-1. There are no breaks given!!

I think you are missing the point - yes, adjusting on a tourist visa is legal, ayone who has frequented these boards for over a year since applying for a K1 would know that - but tourist adjusters do not supply a police report for AOS as K visa applicants do. Considering how long it takes to get a police report in the UK and I have seen such tourist adjusters get approved recently in 3-4 months, I seriously doubt these people have undergone the same scrutiny as someone on a K visa. I don't know if its definitely the case, but I am inclined to believe that the security clearance at country of origin during AOS might not throw up minor charges are only concerned with terror watch lists.

People who are adjusting on a tourist visa are already in the country so I'm very curious what the "waiver" process might involve -- a waiver to stay? I don't know, I've never seen such a person on these boards though they might exist. Maybe they don't because a tourist adjuster with minor theft/assault/ drug charges in their home countries aren't discovered during a quick AOS approval.

You have to answer questions on the AOS application about crime. Of course USCIS is gonna know if someone committed a crime, unless of course the applicant lied. Then they will find out because they do a criminal check.

I know that they will be obtaining a criminal record crck on my from the RCMP in Canada, same as I would have had to have got for my K-3 application. I don't have a criminal record, but if I had, I would have to apply for a waiver just like anyone else guilty of certain crimes in order to complete the immigration process. If you don't complete the waiver or it's not approved, you don't get a green card and have to leave.

I can't see how adjusting from a tourist visa is any faster than adjusting from a K-1 or a K-3 and I don't see any reason why anyone feels that it should take longer.

All I know is that I have seen recent tourist adusters from the UK take 3-4 months or less for their green cards -i know it took at least 6 weeks for us to get the police report in the UK for the K visa. I've drawn my own conclusions.

And the fact that it takes someone less time to get a green card when adjusting on a tourist visa (in my DO) than it does to get an I-129f petition approved in my service centre really pisses me off.

you must be kidding.

we began gathering paperwork for filing our K-1 application in November of 2004...filed in January 2005, and waited until May, 2005 for visa approval. It was not until then that we were finally able to be together, and marry, and file for AOS. For those of us who went through the K-process...spending extended amounts of time away from our fiances or spouses, it just seems quite unfair that some people enter on a tourist visa will full intent of marrying and filing for AOS, and completely circumventing the visa application process.

there's definitely some disparity there.

Of course there is no wait for a VISA interview as there is for a K-1 or K-3 visa, but as far as the AOS interview, I don't see that time from AOS application to interview being any shorter for those who entered on a tourist visa.

As to the unfairness of it all - every relationship is different. People spend varying times apart. I've seen people who just met in 2006 and ALREADY they are married and their spouse has a green card - it doesn't bother me one bit - that's their process - mine is different.

I'm sure many people (like me) who adjust status from a tourist visa have spent significant periods of time away from their spouse. I know that I certainly have. I don't see where it's beneficial to make a contest out of it or cry foul simply because someone had a faster process then someone else. Save that for when something really unfair happens.

Bureaucracy is inherently unfair - i'm just glad that I have the abilities to wade my way through it if need be. Each person going through a system has their own experience. I wouldn't call it unfair that some applications are speeding along - that'll more than likely change at some point and probably sooner rather than later.

Bureaucracy is inherently unfair - i'm just glad that I have the abilities to wade my way through it if need be. Each person going through a system has their own experience. I wouldn't call it unfair that some applications are speeding along - that'll more than likely change at some point and probably sooner rather than later.

I'm a pretty tough cookie myself, jane. But this is about to put me around the bend. I'm wondering what 'abilities' it is you are referring to.

This state of limbo is not a pretty place to be.

so, um...jane. why, exactly, do you feel the need to come onto *this* thread, and try to invalidate the feelings of those who are stuck in namecheck? some of them have been here a VERY long time.

i'll be damned if i won't cry foul, and continue to cry foul.

those folks here who have gone through the K-process visa applications have already been interviewed TWICE...they've been through security checks TWICE...they've paid well over $1000 in immigration fees...and they see other applicants who have circumvented the system by coming on a visitor's visa or VWP with full intent to marry, cutting in line ahead of them. last time i checked, that's still considered fraud, no matter what kind of fancy dress you try and put on it.

no, i'm not saying YOU did anything wrong...after all, you have so little info in your profile/timeline, it's hard to know what path you and your husband followed.

i just gotta wonder...what is to be gained by coming here and trying to tell others that they have no reason to be upset?

It sounds to me like you are saying that you've got more intelligence than a lot of people, or experience, and that if one of these 'hiccups' happen to you it won't bother you?

I understand that you are angry and hostile towards this group.

I'm not "invalidating" anyone who is stuck in namechecks feelings.

But I won't sit here and let you or anyone else say that:

A. people who adjust from a tourist visa are not subject to the same scrutiny as those from K1/3

B. people who adjust from tourist visa are liars and frauds

I'll try to explain what I mean. There are a lot of people who can't complete their forms for various reasons - anyone who has worked in a service agency or dealt with the public probably knows exactly what I mean. I suppose I am saying that I feel glad that I was able to complete my forms. I've seen lots and lots of people fall through cracks and NOT get benefits that they are entitled to, because they couldn't complete the process or because they didn't know to challenge people who were denying them benefits incorrectly. If my own application process is very delayed, I'll do my best to deal with it and resolve anything I can in order to speed it up. I'm sure some issues will upset me. I've already had my own glitches and have done what I can. That's all I can do. It doesn't bother to see people have an easy process. It won't bother me even if my green card takes years and years. Their process is their process and mine is mine.
