anthony got a letter from DHS this morning. when we saw the envelope we just *knew* it was his welcome to america letter. imagine my surprise when he opened the letter, and instead found this:

We also got the same exact letter from Nebraska after we contacted the USCIS "Help" Line. Its been one year since our interview last week.

Called the Senator and Congressman again.....told standard line...."Nothing you can do but wait"

We will be calling them exactly in six months as well and then probably write to the ombudsman at that time also.

We also will have to file for our third EAD and AP... Never had to use the AP and we noticed you did.....We will have a family wedding to attend next summer...Never in a million years did I think we wouldnt have the GC by then but you never know...Did you have any trouble getting back into the US with it???

I heard the same thing about future interviews starting in January of 2007; no interview til namecheck is completed; maybe to catch up on all of ours!!!!!!!!!!!!!!!!!!!!!

Our problem is that our marriage is 4 years now. I could of applied for Citizenship..but i do not have any green cards yet. Going to the lawyer on Monday...could not stand it anymore....1,5years after interivew...

what would you suggest us to do...

I don't blame you. That's what I'd do too. I've never seen a sequence of events like the ones you posted above. I hope you stay in this thread and keep us up to date on what happens with you....

From what I have read in other places, its not a bad thing to have *no record*. I think its pretty common to have this response.

Here is more info on the difference between the FOIPA check and the FBI check we are all pending:

Freedom of Information and Privacy Act (FOIPA) vs. Name Check: Freedom of Information and Privacy Acts (FOIPA) requests are sometimes confused with name check requests. FOIPA provides copies of FBI files relevant to a specific FOIPA request. For FOIPA, the FBI search uses the name or information as provided in the FOIPA request. A FOIPA search determines whether there is an investigative file associated with an individual—a “main file” search. For a name check, “main files” and “reference files” are both checked, in addition to searching a name in a multitude of combinations.

Build up your file with correspondences every so often

to *prove* your exhausting all resources. Its called exhaustion

of administrative remedies (EAR).

FOIPA

1. INSTRUCTIONS & FORM

2. Fill it

3. Get it notorized (not required)

4. Send it by snail mail.

5. Wait for 2-3 weeks. You will get a response (hopefully!!)

Processing Times

*If your local office is processing petitions filed 30 days after your file, Call

USCIS (800 375-5283 1,2,6,2,4) and advise them you are outside normal processing times.

You can do this every 30 days and they will provide you with a confirmation #

OR you can contact the Ombudsman

How can this name check process take soooo long, it's ridiculous. Like a muppet i thought this would be fairly quick. I had my interview in Sept 2005 for goodness sake, thats like 15 months ago!!!
