AOS interview successful, but waiting for FBI name check

But on the flipside, if someone actually is a criminal and they apply for a Greencard, they have a good long time to stay here, work, and reap other benefits, before the FBI even takes note :wacko:
...or build a dirty bomb...

Which is exactly why the Ombudsman says the delays must cease..........

My congressman's office called today to say they are working on finding out the status of our case and making sure FBI did receive the request for the name check from USCIS. I was also told by them that one of their *observations* is people from Russia & China are 2 of the main countries that have problems getting their FBI name check cleared because of slow cooperation from their governments. She also stated that 40% of people who call them in regards to immigration are pending because of the name check and there is nothing they can really do other than make sure the case isn't lost in the system.

Hi everyone,

so a couple of days ago I made my business trip for 5 days and came back in with AP, through LA. Things didn't go as smoothly as expected. As usual got sent to secondary... and thats where they pulled me aside. Sat me down and asked me questions for about 15 mins, wrote down my business contacts etc. and then made me wait for an hour. At the end i asked him why I got pulled over, he said you probably got dinged for being british with a muslim name.

So my question is, does this effect my already delayed green card process?

Heres an update on our status.

Day 841.... we are still waiting for our name check. However, we are now scheduled for another interview!!! This is going to be videotaped. How exciting, NOT. We'll keep yall posted on the second interview its next week.

BTW in the timeline of cases pending, our original biometrics was July 29, 2004. The one that is shown is our second one since our bio's expire every 15 months

Apr 25, 2005 - status inquiry since AOS is 90 days overdue

May 2, 2005 - status inquiry letter to Houston office

May 19, 2005 - had a meeting with the ICE ( they said they didnt know I filed for AOS???)

July 7, 2005 - sent a letter to Senator, Missouri Cis, CIS Ombudsman

July 27, 2005 - letter from Ombudsman - they will start an inquiry into my case.

Sept 14, 2005 - receieved a letter from USCIS Houston that I need to contact Missouri ( from status inquiry)

Oct 6, 2005 - fingerprinting- EAD

Nov 15, 2005 - Received letter from CIS Ombudsman-I need to contact the Houston USCIS

Nov 17, 2005 - Received AP and Ead in mail

Dec 28, 2005 - fingerprinting- AOS

Feb 9, 2006 - Aos interiew- still waiting for background check

huskerfan, I'm looking at your signature. You've made some notations at the very bottom that seem to indicate your background check may have some layers to it that the rest of ours don't. But I also see it appears something happened to your petition after it was filed.

Do you have any idea which of these problems is the delay with your case?

Shameless bump and whine....Day 229.

Keeping our fingers crossed for you two! I might have missed your post, but did you call the FBI to make sure your biometrics had been received? Also, when it gets past the processing date for your AOS (in your district office) you can formally contact the Ombudsman.

We waited 11 months for Carina's approval but I am pretty sure that our constant "poking and prodding" at the system helped move it along.

Thanks Dave. Yes I called the FBI and the prints were processed.

We are well outside of the processing for our DO. We haven't contacted the Ombudsman - we have contacted Senator Byrd's office. We are fortunate that we do have a way to communicate with our DO - in fact I even spoke with our AO on the phone about 3 weeks ago. I'm 100% confident that our case is not lost or misplaced at our District Office and that the hold up is with the FBI security clearance.

Something happened this weekend that is probably completely coincidental, but interesting nonetheless. My husband's cell phone rang and when he answered it, there was a gentlemen on the other end looking for 'Bob'. My husband told him that he had the wrong number.

My husbands given first name, which he doesn't go by, is Robert.

Wow, this is a great list. I'm an active moderator of the Yahoo group, and co-founder of American Families United, which is lobbying on the name check issue (in addition to other items):

One thing I would add to the post above: I have spoken with several lawyers who sepcialize in filing writs of mandamus, and they all recommend that you do NOT file a freedom of information act (FOIA) request. I have consistently heard that this is actually conterproductive. My understanding is that documenting INFOPASS appointments is the most important thing you can do for your case, and that other than that, the most important consideration is the time that you've waited. By the way, I filed a writ of mandamus personally for the 3+ year wait for my wife. But don't take my word for it, talk to an immigration lawyer who specializes litigation. They normally charge a $100 consultation, and they will ask you about other very important information that may change you decision on when to file. There are some potentially serious downsides to filing a writ of mandamus too soon or in the wrong situations.

Alternatively, if you can wait for a little while longer, we might be able to get something through and change the process to make it more transparent and accountable, and set up a process whereby you wouldn't need to hire an attorney. Of course, this is dependent upon building up our membership, but there are over 250,000 citizens who sponsor their spouses every year, and there are right now over 400,000 people stuck in name checks, so there is a lot of potential.
