AOS interview successful, but waiting for FBI name check

If we've been married 2 years by the time the clearance is done, does that mean a 10-year card?

i have been wondering the same thing. Hence why I asked previously if the dayum thing is backdated (like the EADs). I will post on the yahoo group to see what people have experienced.

here's the latest update in our saga...

Anthony called the 800 number again yesterday...because our new strategy is to keep on bugging them until we get a freaking answer...and he was told that we should have had an answer from USCIS within 90 days of the interview date. so, they're sending a letter to the kansas city office to tell them that we're officially outside of the processing dates, as today is 115 days since our interview was completed.

i doubt it'll make any difference, but you never know.

if we don't hear something soon, we're planning to take another trip up there for an infopass appointment next week.

this seems to be their standard answer (90 days). I get asked this everytime I call, then of course they send a formal request down to the local office (mine have not been answered - of course!). I thin they are going on a general rule and it may not apply to those stuck in namecheck.

i kind of wish Abdel was willing to do an infopass, we live 10 minutes from the office! He is just sick of it.

i'm sure you're probably right.

but, we are to exhaust all possible means to resolve the issue, right?

my husband may be a little more anxious to get his greencard because we didn't file for EAD. (we thought AOS would be quick and painless..ha!) he is planning to join the army reserves, actually...and can't until the greencard arrives.

the good news is, once he does join, he can fast-track his citizenship, and be finished in one year! :thumbs:

I would say yes it would be a 10 year card.

My GC is dated the day that I got the approval email, not the day of the interview.

2005

Sept 10 I-129F sent to TSC

2006

Interview - February 13th APPROVED! day 152

April 6 - wedding date day 204

Aug 22 - AOS interview date day 101-total days 342

Sept 29 - green card arrives, done until June 2008 day 140-total days 381

2008

June 30 - I-751 mailed total days 1025

2009

March 9 - Removal of Conditions approved! total days 1277

Here is a thought for all of us Name Check folks to think about.

There is a "Citizenship and Immigration Umbudsman" ... and this persons job is to stand up for us poor soles who are lost in Name Check purgatory.

It clearly says on their web site that those of us who are passed the normal processing window and can not get a response to our case should file a case with the Ombudsman.

It even says what you need to do and it tells you what they will do ... including passing your case on to another deparment if that is what is necessary to get the job done. :thumbs:

June 3, 2005 .... Interview success ... we got our visa !!!

July 15, 2005 ..... Kelly moved into our new house

July 29, 2005 ..... Crossed into the USA and got temp.

August 2, 2005 ... Got married in a civil service :-)

October 2005 ... Sent in AOS, EAD and AP for both myself and my son

November 22, 2005 ... Received Biometrics Appointment for AOS

Chicago finally admits they lost all my sons paperwork have to re-file everything of his !!!!

December 17, 2005 ... Biometrics Appointment

April 13, 2006 ... AOS Interview ... told everything looks good but have to wait for the darn name check!!!

Infopass Appointment Oct. 10th - Told to keep on waiting for Name Check

Oct. 10, 2006 ... EAD Renewal and AP Renewal eFiled

November 7, 2006 ... GREEN CARDS ARRIVE !!!!!

Probably we are champions here. We got married in February 2004. F-129 was filed in March 2004. AOS was filed in April 2005. Interview was in November 2005 but my name check isn't finished yet. In fact we started in March 2004 and we aren't done yet. When I read how fast and easy this journey was for others, I feel sad because ours is pretty tough. But on the other hand, it might have made our relations stronger.

I have a question; I-94 was taken at the interview. I'm going to Russia to see my family. Will I have to take a note from USCIS about the interview? Others have I-94s, but I don't. Or do offices at customs have all that information? Can anyone help me?

you'll probably be fine. just be sure that you take all necessary paperwork along. you'll need your Advance Parole, and if you've changed your name since your passport was issued, you'll need a copy of your marriage certificate as well. also, you'll probably want to allow extra time at the airport--especially for the return trip! it took the airline employees FOREVER to verify what, exactly, advance parole meant.

I have written my district congressman with no luck.

They all say it is out of their hands.

I even wrote GW Bush a letter asking for help , but got no reply.

hmmm....what chance are you talking about? we really had no other choice. the KC office refused to give us any notice that we could take with us when we traveled...and they took the I-94 back in June when we had our interview.

Background checks can take as little as 30 days to 2 years. There's no way of finding out where in the process you are and hwo much longer it will take. If you ask your congressman to inquire, they'll turn you back because there's nothing they can do either.

The reason that it takes a long time is depending on your cuontry of citizenship and birth, if the country does not "cooperate" with the US, the FBI and CIA have a difficult time conducting a name check (see if you're on any terrorist lists, wanted by any country, etc.).

All you can really do, unfortunately, is sit back and wait. I have read in some cases where a check was pending for 2+ yrs that someone formally sued USCIS and the background check got expidited. That sounds like a bunch of trouble though.. :unsure:
