AOS interview successful, but waiting for FBI name check

I did not think they were giving out those anymore...

I guess they do ... just not the the people in the black hole with pending background checks...

I was pending the name check on the day of my interview and got the stamp during an infopass appointment regarding the status of EAD/AP (it was more than 90 days since filing the EAD/AP applications).

An interesting thing is that my cases were not touched since Aug 17 (my interview was on Sep 19) and as of now, it still states that they are processing my AOS, EAD & AP.

Our case status messages have not changed since December.

Hello everybody....long time no talk :P . I've been in Canada for 7 weeks (new Grand Daughter and my Dad's 98th birthday) and loved every second of it but I missed my hubby so much. He spent a week and a half in Newfoundland with me then we drove back to Maine together.

We had our AOS Interview September 18 (initally it was set for August 21 but I had to reschedule due to being out of the country). The Interview went fine, we were in and out of the building within 20 minutes. The officer asked my address, phone # and a couple of other mundane questions. Then he asked Bruce where he worked and if I had a tattoo :hehe: ..I don't...but apparently someone with my previous married name has a tattoo.

To make a long story longer (just a little humour here :devil: .................anyway, he told me I was approved pending my FBI background check and from reading this post I may be in for a long wait. Especially since I didn't apply for EAD due to being gone most of the summer I figured I might as well wait for my Greencard. But now I'm not so sure.

Is this wait the norm or is it fairly new?? I'm frustrated again :crying: ..........{{{{{{{HUGS}}}}}

PS...Just for the record I'm still having a hard time adjusting to my new surroundings. It ain't easy!!

June 25, 2004 - Bruce & I met through mutual friends in my hometown in Newfoundland the night before he was going back to Maine

July 1 - First email between us

July 3 - I called him to wish him a Happy Independance Day

Daily phone calls and emails from there on in

October 20 - Bruce drove back to Newfoundland. He planned on staying a week but it ended up being 3 weeks. We knew for a fact we were in love!

March 19/05 - Bruce back in Newfoundland

April 8 - Bruce picked me up in North Sydney, NS and we drove to Maine. I stayed for a week due to work

July 26 - Bruce back to Newfoundland for another 3 weeks. I can't bear to see him leave.

August 10 - He asked me to marry him.........I had already asked him anyway just to make sure*_*

September 30 - I flew to Boston to meet Bruce there and then we drove back to Maine for 2 weeks

November 18 - We filed I-129F

December 1 - NOA Receipt #

December 28 - Received Packet 3

January 6/06 - Received my Police Certificate of Conduct

January 11 - Sent DS-230 Part 1 back to Montreal Consulate

February 3 - Sent off my check list to Montreal Consulate

March 24 - Medical

April 5 - Interview Date.....APPROVED......Yahoo

April 17 - Moving to Maine

May 16 - Bruce & I became Mr. & Mrs. in Las Vegas (Oh HAPPY DAY)

I say for EAD that does not take that long just in case you GC will

besides it gets easier if you can get out of the house and socialize little with outside world.

Winter at home... not so much fun. I have done it in the beginning for 6M and I was MISERABLE.

9/26/2006 - office claims file is floating around somewhere in the mail room, they will find my work permit app and travel doc app and send it for processing

9/26/2006 - drive to LA to double check what they said, office at LA claims that santa ana sent work p, travel to NBC

9/27/2006 - EAD, Travel docs touched

9/28/2006 - EAD, Travel docs tocuhed

9/29/2006 - :( nothing touched, no letters no emails :(:( ---- waiting., will send letter to congressman monday

10/2/2006 - Travel Docs Touched, nothing new on EAD....Wife sent letter to congressman

10/2/2006 - Got Travel Doc in the mail

10/2/2006 9:30 PM PST, 5 email ead approved, will mail me new card

So -- I am now reaching nearly 2 months of waiting (not as long as many of you, but) and I had a minor meltdown about it all and told my employer to send me back to the UK.

My boss -- who absolutely rocks -- immediately called one of the fancy corporate lawyers and they have told me they are going to arrange for USCIS liaison to investigate. However, they told me that the soonest he would be able to look at it was 11 weeks from my interview date, which would be week of November 6.

Has anyone heard of/tried anything like this

so my congressman replied to my wifes request for help., they address my questions on travel and EAD saying that its processed and will be mailed (which it has)..... as for my GC., they said that my file is in Los Angeles (my local office is Santa Ana), they said that if i dont hear back from them in 6 months., yup SIX months, i shd contact them again., wow., thats a wait.

[Report: Thousands wrongly on terror list By LESLIE MILLER, Associated Press Writer

WASHINGTON - Thousands of people have been mistakenly linked to names on terror watch lists when they crossed the border, boarded commercial airliners or were stopped for traffic violations, a government report said Friday.

More than 30,000 airline passengers have asked just one agency — the Transportation Security Administration — to have their names cleared from the lists, according to the Government Accountability Office report.

Hundreds of millions of people each year are screened against the lists by Customs and Border Protection, the State Department and state and local law enforcement agencies. The lists include names of people suspected of terrorism or of possibly having links to terrorist activity.

"Misidentifications can lead to delays, intensive questioning and searches, missed flights or denied entry at the border," the report said. "Whether appropriate relief is being afforded these individuals is still an open question."

When questions arose about tens of thousands of names between December 2003 and January 2006, the names were sent back to the agencies that put them on the lists, the GAO said. Half of those were found to be misidentified, the report found.

In December 2003, disparate agencies with counterterrorism responsibilities consolidated dozens of watch lists of known or suspected terrorists into the new Terrorist Screening Center run by the FBI.

People are considered "misidentified" if they are matched to the database and then, upon further examination, are found not to match. They are usually misidentified because they have the same name as someone in the database.

People are considered "mistakenly listed" if they were put on the list in error or if they should no longer be included on the list because of subsequent events, the report said.

Problems developed with terrorist watch lists after the terrorist attacks of Sept. 11, 2001.

Maher Arar, a Canadian software engineer, was detained at New York's Kennedy Airport in 2002 because Canadian officials had asked that he be placed on a watch list. The U.S. transferred him without court approval to Syria where he was tortured and imprisoned for a year. A Canadian inquiry found that Arar should not have been on the list because he didn't do anything wrong.

The no-fly list given to airlines to make sure terrorists don't board airplanes grew exponentially after the attacks on the World Trade Center and the Pentagon. The no-fly list is part of the Terrorist Screening Center database.

Young children and well-known Americans like Sen. Edward M. Kennedy (news, bio, voting record), D-Mass., were stopped at airports because their names were the same as those on the no-fly list.

The list has contained the names of Bolivia's President Evo Morales and Nabih Berri, Lebanon's parliamentary speaker, according to a report by CBS' "60 Minutes," to be broadcast Sunday.

Richard Kopel, acting director of the screening center, said in a statement that Morales and Berri are not on the current no-fly list. He did not address whether they were in the past, noting only that the list changes daily.

Two international flights — in December 2004 and May 2005 — were diverted because passenger were misidentified as on the no-fly list.

Homeland Security Secretary Michael Chertoff said in a telephone interview with The Associated Press that watch lists aren't perfect.

"The watch list was the first stage of building a security net for the aviation system," Chertoff said.

He said an agreement reached Friday between the U.S. and the European Union would help prevent people from being misidentified.

The agreement calls for airlines to submit 34 pieces of data — including names, addresses and credit card details — about passengers flying from Europe to the United States.

The report said agencies are working to minimize the effect on people who are frequently misidentified.

TSA puts people on a special list of names that have been checked and cleared after they've complained to a call center and provided the agency more identification.

Customs annotates its database with a note that certain people shouldn't be stopped. As of September 2006, Customs annotated more than 10,300 names. Customs also gives preapproved low-risk travelers ID cards that provide expedited processing.

Customs acknowledged to the GAO that it needs to do a better job of providing guidance for their redress procedures for people who believe they've been misidentified.

The Justice Department is leading an effort to make sure that all agencies formally document opportunities for redress and that agency responsibilities are clear, the report said

Well, the first thing I wonder is if the fancy corporate lawyer counts immigration law as one of his areas of expertise. My boss won't touch it with a 10 foot pole and says it's best left for those who specialize in it.

I'm not sure where this ''11 weeks" comes from. Maybe that's something the fancy corporate lawyer knows that we haven't read on here?

The common wisdom is to start the ball rolling with liasons, congressional or senatorial requests, and other forms of communication with USCIS after the processing time for your particular office has passed. Is that the 11 weeks he is referring to?

I don't think 11 weeks would take us to processing time since that would be the first week of Nov and the LA office is currently processing March.

I think I see what he is doing. He's making an educated guess of when you will be outside of proessing times.

You filed in May. You state that your office is currently processing March. The processing dates are usually rolled monthly.

I think he's saying that if the dates are bumped to April later this month, then May the next - then about another 30 days after that you could request assistance and it not be premature.

I never knew that about the processing times. My district office is not even listed, I am assuming it is just to help the overflow from the main NYC one. I checked and NYC is currently processing 485 cases filed August 30, 2005! Ummm yikes. :wacko: Guess I better keep waiting.
