Having started this thread just a few days ago, it looks like we will be dropping off!! My wife just received an email from USCIS indicating that her 'Welcome to America' letter was mailed today!!

We wish the rest of you well and hope for a speedy resolution to the dreaded name checks!!

As far as being patient goes....my entire career has been put on hold. Last year I was hired by an airline to be a first officer. I was about to start training when I was told that my security clearance was denied. I now need to wait until I get my green card. It takes a lot of time and work to eventually become an airline pilot. I have worked my butt off over the last seven years only to be stopped by the USCIS. I can't even work in any type of airline setting.

May 19, 2005 - had a meeting with the ICE ( they said they didnt know I filed for AOS???)

Sept 14, 2005 - receieved a letter from USCIS Houston that I need to contact Missouri ( from status inquiry)

huskerfan, I am sorry to hear your plight and hope you can get satisfaction soon. It is so distressing to hear stories like this and how red tape gets in the way of progress and peoples lives. I just don't know why the interviewer lied to us and said that it was all but done. She said that she could do the check herself in 10 minutes but her superiors didn't want her 'to waste the time' doing this.

I thought that it was time to 'bump' this thread to the top again, because it is important and offers some support to those of us stuck in 'pending FBI name check' hell and the 'sort-of approved' club. I also had an interview on 05/11/06 which ended with "everything looks great, but we are awaiting results of the FBI name check". I read an interesting article today written by an immigration attorney on 05/11/06 which stated that there is actually a loophole which lets immigrants sue for citizenship, adjustment of status, etc. The article states that under federal immigration law, USCIS must receive the FBI check prior to the interview and that if they do not, applicants are rightfully able to sue for immigration benefits if 120 days pass and the agency has not made decisions on the applications. Don't know exactly what a lawsuit of this magnitude would entail, but it's somewhat comforting to know that there is at least one course of action that can be taken, other than just waiting around for the name check to clear. Another article that I read stated that as a last ditch effort, applicants can contact William L. Hooton, which is the Assistant Director of the Records Management Division at the FBI. Although it is strongly advised not to 'nag' this person. Let's try to keep this board alive folks and please update your timelines as those of us stuck in this limbo are lucky enough to get pulled out.

You'd think all those background checks would have been done and okayed when our significant other's have come in on the K-1 visa or K-3. Now they are here and they have to be rechecked for terroism..

in our case they WERE! we had nearly 8 months waiting for security clearance for K1 now we are going through the same sh!t again for AOS.

rediculous, but i should have known this would be the case.
