AOS interview successful, but waiting for FBI name check

a little note on EAD's:

you are technically allowed to work with an adjustment pending. period. the EAD is to show that you are, if a new employer asks you for it. if you were to, let's say, take a job on jan 1 and your EAD then ran out on dec. 31 of that same year, and your new EAD would come in the mail in, for example, march...would you stop working for 2 months? would your employer care? would anyone?

a resounding "no".

as a matter of fact, i have had 3 EADs through two sponsorships (one employment case which was approved but i abandoned it since it took forever to get a "visa number") and i never showed my EAD to anyone...because i am SELF-EMPLOYED! sometimes, just for fun, i would show it to myself and feel so approved.

my point: this year, if my EAD runs out prior to my GC (ugh), i will not renew it and pay the USCIS another $180 to have it sit in my drawer. if you have a secure job with no reason to re-prove that you are legal and you are waiting for your GC, i suggest you forget that stupid EAD. it's a rip-off and even my lawyer told me so. (if you work with a pending adjustment you are doing so legally. you are...what's that word? oh, yes...entitled.)

i see your point, i came to the us in 2000 as a student, got a on campus job, which got me a ssn... got married in 2004, filed for my first AOS. got EAD., now i cld work ofcampus., got employed., ,

on the day of the interview, (after the interview) xwife and i had a major argument., i withdrew my aos,. filed for divorce., fell out of status. , got married again, got reinstated to student., terminated removal proceedings., and then i am pending AOS., yes my case is complicated., but my point is that i had an EAD from my xwifes petition.. so its always been a gray area., i just want it again so i can change jobs and get a $110k job that i interviewed and have an offer for!!

I know the "touched" means nothing but I'd love at least a little grope. Just some sort of USCIS action

I dont know how much the online update after the biometrics means, because we did get both our EAD and our AP in the mail though none of our online cases were ever updated to say they biometrics were done. Who knows? It's all insane.

Carina had no problem getting an AP (both of them! ) and she did not need the EAD....the problem was with the AOS and the name check/fingerprint issue. FBI is not involved in the AP/EAD issuance as far as I know...just the AOS.

I still think it is worth the phone call to the FBI just to be sure the biometrics were received.

Last week Our Senetor's Office called and said i will be called for.. to Give them My Finger prints as they Got Expired.I know This when I went for My 3 EAD in JUNE Itself.when we Asked the Bench Clerk about the status on 485- He said My Finger Prints show Expired but Name Check has Not been Cleared.( He Tired to Act smart saying He is Not Going to say which One is Not Completed, out of three Two Got Cleared and One More Awaiting) I was Like Holy #######... I Know that Dude there is Nothing New Info..For People Who Drive/Fly by Getting an Appointment to know their Case status ...Just to hear this uncanny reply.

Literally it cost me $1000 on that Day.

Sure Enough Last Friday INS sent a letter to Have my finger prints done on 10/12 to continue the Processing of My Case,Suprisingly i got Another letter saying to Apper on Nov 5 which is sunday.I am just ignoring the later One.still I have doubts in minds is Oct 12 (which is a Columbus Day) INS offices will Open?

Lets assume My case is Approved..Thatz why they called me should I let INS officer know I should qualify for 10 year GC as i am over 2+ years of marriage?

i have to vehemently disagree with the suggestion below. Let me break it down for you.

My answer is also 'NO' to this question but for very different reasons then you have suggested. There is no reason on RENEWAL to stop working as long as you have your NOA. This is sufficient to continue working. An initial EAD is a diferent situation.

there is no reason to renew your EAD??!! Wether you are pending adjustment or not, an unexpired EAD is a requirement for employers. Yes, it is a rip-off for people stuck in the system, but seriously, there is no such thing as entitlement in immigration. If your lawyer is giving you this advice (which sounds more moral than legal), it's best probably kept to yourself as it may work for you, however the mainstream are doing best to follow the law.

I just called the FBI office (per DCL 1-304-625-2000), fingerprints/biometrics were received & returned on 3/2/06. I feel grateful that this is not the problem.

well, just an update here, kids...

we had an infopass appointment this morning, at 7:30 am. we went to check out the status of our application, since they told us on August 14 that we'd have a determination in 30-45 days.

well, surprise! the officer said, "well, they have a request for evidence here...did you know about that?"

we have NEVER received any RFE related to our case, other than the RFE we got last year for anthony's AP. (that time, they had somehow lost his passport photos.)

so the lady gave us a pink inquiry form and told us we should have some sort of information from them in, you guessed it, yet ANOTHER 30-45 days.

so...

when Anthony got home, he called the Customer Service 800 number, only to be told that he should make ANOTHER infopass appointment to speak to an immigration officer. so he's going back in again tomorrow at 8 am to make another inquiry on our case.

we're "lucky", i guess...we only live 45-60 minutes from the office.

i'm getting a little annoyed and a LOT worried about this whole thing. ack!

Okay ... so I have been away for a long while (from VisaJourney that is) ... and I am so deflated by what I am reading in this thread

When I had my AOS Interview back on April 13/06 in the St. Paul office we were told that everything is fine but he couldn't give me the approval on the spot. He explained that the name check hadn't come through yet and we would have to wait. Before we could even ask how long we would have to wait he jumped in and told us the earliest to start looking for it would be October!!!

OCTOBER ????? I said. He said ... yup ...

I then pointed out that Chicago had completely lost all my sons paperwork and I had to re-file everything ... and well I was a little worried about our files "sitting around" for that long. Wouldn't they be at risk of being lost again. He told me that the file would stay in the St. Paul office until everything was finalized.

I saw a few posts ago mention of calling the FBI. Is this something that any of you have done? If you have what did you tell them ... what did they ask you?

I have an Infopass appointment on Oct 10th to see if I can find anything out from the office of miss information. I am hoping a warm smile and a calm voice will lull them into a false sense of wanting to actually help

Is anyone else out there waiting on the St. Paul office too?

Hi Norma - I called them yesterday as I posted above. I selected the option of Immigration on the auto-attendant, got a switchboard operator, told them I wanted to speak with someone regarding immigration fingerprinting. The rep who answered looked us my husband's "A" number and confirmed prints were received and returned.

This has no bearing on the namecheck. Its just another possible hiccup to eliminate as a problem.

Hi Norma! We went through St. Paul also, and were also told during the interview that the name check wasn't done yet....

The officer told us the same thing, the case would remain in St. Paul until the name check results come back, then it gets the final approval and will be processed for Green Card issuance in Missouri.

She also told us that the St. Paul office checks for cases with name checks pending on a weekly basis, thus trying to eliminate any further delays.

I had my Green Card in the mail on Monday! Still rooting for you guys!

Dani, I am so sorry to hear what happened. For them to have given you false hope and then come up with some RFE that they cant even explain. The lack of communication that goes on in this whole process is absolutely appalling. It makes me wonder if the officers even have a clue or they just hand you a pink slip and tell you to come back in 30 days so they have time to make up another excuse. I know there are a ton of immigration cases to contend with, but America is supposedly built on the foundation of immigration and I really expect a better and more efficient system for all the talk they spout and the money we pay for these cases to be processed. We pay a ton of money for each application, we follow the rules and we are still left chasing our tails. I just don't get it.

And Rebecca that is horrible. Can you try to get a mortgage in your name and add Wes later, or do you need his income to get the mortgage? Hmm the USCIS wants us all to prove we cohabitate, so both parties names need to be on a mortgage, but how can that happen when you cant get a mortgage without a greencard? I know I am being negative but sometimes I think this is purposely made difficult so as to discourage people.

so...

we went back up to the USCIS office this morning to speak to an officer, as advised yesterday by the customer service line. i'm not sure we ever actually got to *speak* to an officer...but the gentleman who helped us today was SO much better than the lady yesterday!

when i explained to him that i know our file is in that office, because i saw it on the officer's desk when we had our interview in june, he took a look at our information on the computer, and said, "let me just go take a look. i'll see what the RFE is for, and get you a photocopy of the letter they sent out to you before you leave today."

so, we sat and waited while he went in the back to look for our file. after about 10 minutes, he came back out front and told us that the RFE is for fingerprinting.

"wait," i said. "he just had those done recently, and here is the notice from that appointment." and i pulled out the copy of the notice to appear for code 2 biometrics and handed it to him.

i told him that we had 10 prints done before our interview, and then we did the biometrics in july.

he took the notice, and went back again to speak to the officer. another ten minutes or so, and he came back out to say that everything in the file is complete, there is no RFE, and as long as our security check is complete, we should expect a decision soon.

you know...this is crazy. i fully believe that it was only because we showed up in person that they took our piece of paper from one file and put it in another. the worst part is...if we hadn't been proactive, they would have probably considered us to have not responded to the RFE (that we never received!), and could have considered our petition abandoned!

i encourage you guys to keep ON them...keep checking on your file...keep writing them..keep calling...keep visiting the office...obviously, it's necessary to ensure that the file stays on top of the pile.

and so now...we wait.
