AOS interview successful, but waiting for FBI name check

I had a feeling there was no logic.

The officer at the interivew swore the case status would be updated in a timely manner. But then again, he also said that pending name checks were very rare

I told him that both our EAD and AP came in the mail about two weeks before the online case status said they were Approved, so that there seemed to be a disconnect in their system.

He just gave me a blank look and said he didn't understand why that happened, then ushered us out. I dont think any of them know a darn thing.

Well, it was explained to us that 'systems are improving all the time but certain aspects have not caught up'. We were also told that this is 'checks and balances' system and that to some degree, the different branches underneath the DHS umbrella aren't SUPPOSED to be able to access one another's information.

precisely why i felt our *stay* with the DOS was much more organized than our current stay with DOH/DOJ.

Carina has received 2 separate letters recently. The first basically told her to sit tight and that a request for the name check was sent to the FBI on 07/13/06. This was in response to one of her inquiries to the USCIS Ombudsman.

The second letter was a request for her second biometrics appointment for fingerprinting. It says she should go to the ASC during the 7 day period starting 09/12/06 or if this is not possible to go on any Wednesday following that period. If she doesn't complete them within 84 days her application will be considered abandoned.

We will be going this Saturday, and she will have to miss one of her high school tennis tournaments for it.

I am thinking they got her name check back and then saw that either the first set of biometrics were lost or realized that her fingerprints are expired. The first biometrics appt was completed 12/31/2004.

Hopefully all of this is a good sign....

Dave

Thanks to all for the guidance and support and speedy processing to all!

just throught I'd chime in. we filed for my AOS in 1/2003 and finally had our interview this february. since then we've been waiting on the security check. of course, this is NYC and so everything takes much longer, but still this endless wait is infuriating.

I'm thinking about making an infopass appointment in a month or so -- anyone have any luck there?

Hello knitty

joining me in to the NYC nightmare;) I have not seen someone who filed even before me for a long time.

Not to long ago here on VJ was someone in NYC recently approved who filed in 2003 as well.

I did Infopass on 4/11 this year... no luck whatsoever. I have been told that my application has been transferred to Service Center to California for the background checks. (which I did not know at the moment)

They have advised us to write a letter to address they have provided and inquire about the status.

After we did so we got letter back that they don't accept inquiries via letters or faxes... Seriously?

Anyway... I guess they will tell you where your application is but if you know that ... they are not much more help than that. But they must see little more than the people in help line... because those still do not see that my app is in CA.

Either way if you decide to go make sure you schedule the first possible Info pass which is at 7.00 AM things go much faster and you wont be waiting so long...

Best of Luck

Luc

i just don't get it. why should an adjustment from a K1 take any longer than a CR1??? we have seen CR1's take a year from start to finish. Am i totally off my rocker in this case? Would we *really* have the same trouble if we did CR1's? since CR1's are still at the consulate level, then they would be dealing with DOS, which in my opinion is more organized and has a better system than DOH/DOJ. (or at least in my case it was the consulate making the errors)

i am tired of this, its as if the whole K1 is #####'ed up.

I often wonder the same thing and have occasionally kicked myself for not doing the CR1. If I knew then what I know now I definitely would've gone that route.

Do you really think so? I've thought the same myself but I've kind of assumed that the CR1 would have been protracted by this check. Am I wrong?
