She submitted the "formal request" to our local office as we are outside of the normal processing times, there has been no action withint the last 60 days and our interview was more than 90 days ago.

It seems like every case on this thread says they were Approved pending name check. I might have been in a haze because I was shocked at not getting approval, but I don't think my interviewer quite said that. He said that we were Pending and he was recommending approval. He said once the FBI name check came in that if the case landed on his desk he would approve it. But if the case lands on someone else's desk they will just look at his recommendation, but they have to review it themselves and they may not approve it. Is that just standard mumbo jumbo they have to tell you or did we just not do well? I keep second-guessing myself now and think maybe I was overly friendly or that maybe I hesitated a split second when they asked us our wedding date (I always get it wrong by a day so had to hesitate to get it right).

Any input may put me in better spirits.

Estella -- we were told pretty much the exact same thing. We were not told we were approved at the interview (though the officer said congrats) - that they would mail a decision. We recieved a letter saying our case is under "additional review" which nearly caused 2 heart attacks. We scheduled an Infopass appointment to be told it was the FBI name check -- he then told us that a decision wouldn't be made until the clearance came in.

I'm guessing and hoping it's only procedure, although I worry that they see our vegas wedding (no guests, non-traditional wedding clothes) as somehow less than acceptable.

Thanks Robin, It's comforting to know I'm not the only one in this boat. I kept waiting for the interviewer to say "You're approved pending..." or something like that.

I don't think the Vegas wedding would have much to do with it, since a lot of people who get Approved had simple city hall ceremonies. I think as long as you show joint finances and lifestyle. Then again, I am sitting here second guessing myself as well. When the officer asked me if it was love at first sight, I said that my husband was stinky when he came off the plane, but after he bathed, it was love from then on. I can't help it, I just can't be a stiff serious robot in an interview!

I just feel like it's a timing thing. If you have your security clearance at the time of the interview you get your Approval if all papers are in order, but if you don't have the clearance you go into the black hole of "pending" which a lot of people never emerge from. I think maybe their paperwork just gets "lost" if everything is not right in front of them at the time of interview.

That's what I'm thinking too.

It's just so unsettling having your whole life in the hands of some bureaucrat. For me, the worst part of the whole process has been the time between the interview and now -- looking at people's timelines on this list and realizing it could be months or even years -- it just feels like I don't know when there will be any resolution.

The most upsetting thing being my husband found a job where they needed a greencard in order to hire him -- 2 weeks ago, we thought he would be able to take it! It also seems to complicate matters when applying for a mortgage, since we were planning on buying somewhere this year. We'd love to be able to plan for the immediate future, but it seems we can't.

I just took a look at your timeline Robin and your bio appointment was not that long ago, so the FBI is probably just backed up.

Does anyone know if having common first and surnames slows down the process?

Biometrics have nothing to do with the clearance. It's a namecheck - pure and simple - and supposedly it's begun when your case if filed.

I don't know if it would be correct to say 'illegal' if someone won't hire you because of a greencard. For instance, the federal government themselves won't hire you (for most positions) without citizenship. There may be some latitude with state, county and city government jobs as well. But it sounds more to me like a case of the employer not realizing that the EAD was legal work authorization. Perhaps somebody should present him with an I-9 form to read....

And yes having common names does slow the process down. Grindingly.
