AOS interview successful, but waiting for FBI name check

Thank you for the kind words. The reason that I didn't and cannot apply for AP is that I 'overstayed' my visitor status and it was recommended by my attorney not to apply for it because we could run into some problems, such as being slapped with a 3-10 year ban upon re-entry. As for knowing that my case has been 'touched', the reason that I know this is that I signed-up my case on the USCIS website and you can look there for updates on your file. There is one field that is called "Last Updated Date" (or something close to that) and it tells you the last time that something was done to your case by USCIS. Go to the USCIS website and look for a section that is called "Online Case Status". All the best of luck to you!

thanks for the input! i actually signed up already but never noticed the "last date updated" part! must have been blind! mine was touched on july 16th. wohoo. whatever. at least someone looked at it.

i also received my FOIPA request today. that stands for freedom of information privacy act, and it means you can request from the FBI a letter stating whether or not you have a record. even though i knew i never did anything that the FBI would record, i was just curious. it came back as "no record' in 2 weeks time. unfortunately, that dept. is not the same that handles name checks. they are the efficient and fast people in the cubicles next door, apparently.

well, good to know i'm not a felon. and i'm not hiv-positive. all those things you find out about yourself when you go through this process!!! delightful! lol

this story was posted on the off-topic forum...but i wanted to share it here. shame they won't let those of us waiting for background checks join in the class action law suit.

Well, you can add me to the ever increasing list of poeple waiting. We had our AOS interview today, and I had prepared so well for it. We answered all the questions, and he said "Everything looks good.....but we are still waiting on your FBI checks". Then he cheerfully said "It could be a day, a week, or a year. We even have cases that are over two years old!". Thanks for really kicking a guy while he's down! :angry:

I feel very numb about it all really, but at least I'm here, I have a job, and I'm grateful for all of that. I just really wanted this process over with so we could finally rest easy for a few years. Now the wait goes on....

WELCOME! I know none of us would like to be here if we had a choice, but at least there is good company! Congrats on the successful interview, maybe one day USCIS will realize that we are more than just "A #'s" and receipt numbers, and think about moving into the 21st century when it comes to forms processing.

Wow, it's sad to see that our list is growing rapidly, but none of us are really getting removed from it.... :( Something really has to be done about this, it's totally ridiculous... :angry: Why even bother processing cases so quickly, just to be held-up by something else?! Ok, that was my venting for the day...lol.

Hello everyone. Please give us an advice. Our time line is filed for AOS May 2004 had interview May 2005 FBI name check pending. What if we will hire a lawyer to check what's going on. Does it worth it or not?

Tired of waiting. Last update was on 7/18/06 on F-129 form.Thanks

hiring a lawyer will do no good. our lawyer was with us for the interview and she couldnt do anything either. she just keeps telling us u have to wait. nothing can be done.

i did talk to the congressmans office and he said...well if its any consolence to u...weve never seen one denied. oh yeah...that makes me feel better. we just want the card now.
