Thank You. I am pretty sure this is due to the feb 04 memo...I did not get any welcome letter or any case approved status. Anyways as long as I have the card I care less.

Earlier the ball was on our court and we wont get a GC until our background check came clean...Now after the 180 day rule the ball is in their court and we would have our card unless something objectionable comes up. Everyone should have their card very soon.

The officer said our case has been under review with an officer (I don't remember the exact wording) since March 14, 2008. I'm guessing that was when the results for the 3/3/08 biometrics came in. He thought we'd be hearing very soon and told us not to move. (Like I would do anything to jeopardize mail delivery at this time!)

that was the response i got for last 2 Infopass appointments , "pending decision by a officer", on my last Infopass the officer said , change of address!!! it is goint to slow the process :blink:

I just found out about the new rule for the FBI namecheck (we have been waiting 1.5 years). I was going to make an Infopass appointment to find out what was going on, but I decided I would call first. I finally figured out how to get to a person on the 800 number from a website (USCIS (the INS) 800-375-5283 After selecting English, (with a 2 second delay between) 2 6 2 4), the guy asked me lots of questions, asked to speak to my husband to verify that he was present (I am the petitioner), then said he was transferring me to someone else who could take the next step (he talked really fast so I don't know who/what exactly he transferred me to). I then talked to another lady who said it looked like my case should be processed according to the new rules, while I was on the line she sent a message to my local office, and the next day I recieved the email notice saying that card production had been ordered. After all this stress and waiting I can't quite believe that it was so easy, so I'll believe it for sure when I get the card in the mail.

Ugh! EXACTLY what I didn't want to read, I read today when opening mail from USCIS. In response to my call on March 10th, they looked into our case. The letter recieved today states -

"The status of this service request is:

Based on your request we researched the status of this case. We are actively processing this case. However, we have to preform additional review on this case and this has caused a longer processing time. If you do not recieve a decision or other notice of action from us within 6 months of this letter, please call customer service at the number provided below"

Ok first off, what the heck do they mean by performing addtional reviews?!?! We were clearly told by the woman giving the interview that as soon as the FBI name check cleared, she would approve us. Please tell me that's what they're getting at. I read on here someone recieved a letter stating they were waiting on their background check and since ours doesn't clearly state that as well...makes me a bit nervous. And as far as waiting 6 months...I think not! Today is day 133 since our interview. You bet ur a$$ that on day 180, if nothing has been heard otherwise, I will be contacting the, regarding the new "rule".

Question: Has anyone actually called the 800 number and asking about the new rule for pending name checks after 180 and gotten a decent reply?

Well it finally arrived. It has been almost 9 months of waiting since approval at the Portland office. All in all it took just over a year for us. I applied last April 5th and received the email this morning. I had called the 800 number to ask them to look into my wife's case about 3 weeks ago. Don't know if it had anything to do with it. Anyways good luck to everyone else out there especially those who have been waiting longer than us. Our prayers go out to you all who are still waiting. Good luck.

They don't pick people, everyone goes through the FBI namecheck. Just some get stuck longer than others.

While it is true that all apllications are subject to background checks, I believe your ethnicity, nationality etc all play a big part in whether your application is delayed or not. I have a friend from Singapore who got his green card after coming here on vwp, overstayed for 3 years and married a usc and got his green card in 3 months. A colleague from work had his girlfriend come from Poland on a visitors visa got married and got their green card in 2 months. Both my sis in law and brother in law gc applications took over 1 year along with my wife's. Also seeing some of the other cases that are on this board and others I can't help but notice that there is a strong correlation with delays and where your beneficiary is coming from etc. I guess all the delays can be attributed to 9/11 and it's subsequent changes to policies.

We've been waiting a long time. They've said it's b/c my husband's mexican last name is common here. We've had a few other friends fly right through. Two were Mexicans granted asylum and one through marriage. However, they have a much less common last name. I've heard that lots of canadians and brits have been stuck in the name check for the same reason.

It's crazy that you can come with a full police report from your country on the K-1 visa and then get stuck here when you've never even been to the country. I kind of think the employees told themselves, "well, it's only 2% of people that are still waiting, so who cares."

But now, they are being forced to care. thanks to all of the lobbying and senator requests.

7/03--Interview in Ciudad Juarez

2/15/04--Married

4/2/04--AOS submitted

8/23/04--Interview in Chula Vista, CA (approved pending name check)

5 EADs, 3 APs, multiple Senators' inquiries and infopass appts, 2 AOS biometrics,

and one move to Seattle later...

3/3/08--AOS Biometrics renewal in Seattle

6/9/08--10 year green card arrived in the mail. My husband is no longer in immigration limbo and is a realio, trulio permanent resident! It says he's been a resident since 04/17/2008.

1/17/11--Apply for Citizenship

I just hv no idea~ 2 of my fds like me, they ar form Hong Kong N got K-1 Visa to be here, they got there GC without interview N within half yr. But for me, i got a interivew N still pending for the name check~ :(

My husband's AOS took over two years because of name check. He has a common English name, first, middle, and last.

K-1

March 7, 2005: I-129F NOA1

September 20, 2005: K-1 Interview in London. Visa received shortly thereafter.

AOS

December 30, 2005: I-485 received by USCIS

May 5, 2006: Interview at Phoenix district office. Approval pending FBI background check clearance. AOS finally approved almost two years later: February 14, 2008.

Received 10-year green card February 28, 2008

Awww it sounds like a common name is not good?! :huh:

Is it because too many ppl got the same name, so the FBI have to spend more time to figure out who is who???

- 11-28-07 I-485/I-765/I-131 sent

- 12-06-07 NOA1 of AOS

- 12-18-07 received RFE for I-864

- 12-20-07 EAD and AP touched (Notice Returned as Undeliverable)

- 01-04-08 Biometrics appointment done

- 01-19-08 resent hubby's income proof

- 01-28-08 AOS touched (Response to RFE received, and case processing has resumed)

- 03-10-08 EAD and AP finally touched and approved!!! =)

- 03-12-08 Case Transfer to CSC

- 03-13-08 EAD Touched again (Card Production ordered)

- 03-17-08 AP and Transfer notice received in mail (AP valids until 03-09-09)

- 03-18-08 EAD touched again (Approval Notice sent)

- 03-20-08 EAD received in mail

- 03-27-08 AOS Touched everyday since 03-20 (Case pending)

- 05-30-08 USPS shows my RFE reponse was delivered at 11:22 AM in LAGUNA NIGUEL, CA 92607

- 06-04-08 RFE received and case processing has resumed

- 06-09-08 GC Card production ordered and welcome letter sent (6 months waiting!!!)

- 06-12-08 GC Approval Notice sent

- 06-16-08 GC and welcome letter received

Finally, I got my I-485 approved, and my card is on the way.

PS. I did my 2nd fingerprint in March 1st, I think the memo works, and hope you get yours soon!
