AOS interview successful, but waiting for FBI name check

i still havent got anything in the regular mail like they said i was sent on the 1st but i know its only 5 days later.

anyway. so when can he start filing for citizenship? is it 3 or 6 months before this 3rd year?

it this when we are supose to also keep track of all the time spent outside the united states or should i have already been keeping track?

Yep Lab is correct!. By the way my wife sent her greencard back today with a I-90 and marriage certifcate and a letter explaining she had been married for over 2 yrs when she was granted permnant status. Hope they square it aways she recieved a 2 yr instead of a 10 yr. Isnt that crazy wait for 2yr and 4 months and they still screw up. Well i made copies of everything so we will see and i had it certified mail with a signture required.

Okay guys, so my husband called the 800 customer service number to ask about the status of his namecheck. We went to our interview Oct. 17th and were approved, pending name checks. I know we haven't waited that long yet.

When he called they transfered him to various people, and then he finally got transfered to an IO. The IO told him that fbi name checks are taking longer to process now because of the huge increase in filers since June. The IO also told him that he is going to need to renew his EAD and his AP (his current ones expire in August) because he is going to receive his greencard until late in the year 2008!!!

I was thinking WHAT!!! He will be cleared out of name checks until the end of the year? Should we believe the IO? I thought that the IO's did not know the exact time someone would be stuck in name checks. What do you guys think? Is it possible the IO's know when name checks will clear? Or do you guys think they just know an approximate time frame??

I don't want to frustrate you, but if i am in ur shoes i will never ever believe them, they absolutely know nothing, they are there just to keep us on hold, But lets hope that he will get rid of this very soon!!! Insha'allah (God Willing)

December 30, 2005: I-485 received by USCIS

May 5, 2006: Interview at Phoenix district office. Approval pending FBI background check clearance. AOS finally approved almost two years later: February 14, 2008.

Received 10-year green card February 28, 2008

I have to agree with the others--that sounds like nonsense. I could understand the IO encouraging you to get used to the idea that you might have to renew EAD and AP, but if we've learned one thing about FBI namecheck, it's that no one--like, no one--can tell you when the name will clear. Only the FBI seems to know, and they're not telling anyone! (until the namecheck clears, that is) It seems irresponsible of the IO to give you an arbitrary time, like late 2008.

Unless I'm not getting something...

Hi all,

I am following this thread because I received a stamp in my passport at my interview back in November. However, I didn't receive an approval notice or anything until finally, last night, the green card card production notice came in. I am starting a new job now, and don't know if my passport stamp is acceptable proof of eligibility to work, or if I should give them a copy of my EAD, too. I have to submit my paperwork on Monday, so I can't wait for my card. My question is, is the stamp equal to a green card for employment, or is it just to allow you to cross the border.

Aug 2002

Entered US on TN work permit

2003 through 2007

Renewed TN Annually

March 2007

Eloped in Central Park on vernal equinox, then honeymooned in Paris.

April 2007

Early April: Renewed TN on return from Paris

June 2007

Sent in AOS/I-130/EAD package

July 2007

July 14: DOA1 - delay in processing because CIS told me to send package to the wrong center.

Late July: Received Biometrics notice

Aug 2007:

Aug 2: Biometrics Appointment

Aug 8: Received RFE for missing medical forms which CIS told me originally not to send in!!

Aug 16: Medical Forms Received at CIS

Aug 24: Received e-notice that EAD card was ordered (No more TN! yay!)

Aug 30: Last day of work on TN. Laid off from job. :(

September 2007

September 5: Received Card! Just in time. Started part-time grad school today.

October 2007

Oct 2: Received Interview Notice: Whoo-hoooo!

November 27 2007

Had GC interview, which went smooth as silk. Received passport stamp, too.

borealgirl, im not sure about the stamp since we never got one but i think it is good for employment but really im not sure. i dont think any of us in here got the stamp becasue we were waiting name check so not officially approved.

i just got my approval notice today. really it seams strange the approval came after the welcome letter and card production ordered.

well sand u could challange with us but the problem is...u already got ur greencard which makes u a winner.
