AOS interview successful, but waiting for FBI name check

Well.....

USCIS may actually be doing something different than what they've done in the past.

I'm going to completely conjecture here. None of this will be factual - just based on what we know of how the system works.

Normally, they didn't order a new set of prints until the namecheck was done. Even if the prints were beyond 15 months old, they just let them languish until they were ready to produce a card.

They may now simply be 'cleaning house'. OR - they may be ordering new prints again and sending them to the FBI in order to move these old cases off the dime. My understanding is USCIS is really none too happy with the service they have received from the FBI. And allowing 'potential evildoers' to remain in the country while DHS idly sits by and allows months and years to pass doesn't look good on them. The issue with the 9/11 bombers was DHS had admitted them. The problem USCIS has now is people are admitted but they aren't cleared. Therefore they may be doing a housecleaning in order to shift blame to the FBI in the event one of you people turns out to be a terrorist (as my husband used to be one of you - I hope you catch my sarcasm).

Local offices may be doing something similar, but their chagrin is the case file lying in their office and making their stats look bad. Some offices may be ordering prints again hoping to get the case to move.

Third possibility - and this is not conjecture but anecdotally factual - some cases may be namecheck cleared but the local office is allowing card production to languish. When a case is completed, the AO who originally interviewed has to sign off on the file, and send it on to his/her supervisor for approval. They can't do that until another set of biometrics has been captured, so in that case they (the local office) will send notification to the petitioner that they need to collect another set of prints. After prints are captured and the AO signs off on the case, it moves to the supervisor's desk. After the supervisor approves it, it goes to another clerical section for data input that starts card production. If the office is backlogged, sometimes an approved file can take longer than necessary to move through the system.

Soooooooo....for those of you who received the 'white paper' from the local office - I would suggest you stay after them about your case status. You may be cleared. If you aren't, they should be able to tell you. My husband's 'white paper' notice that another set of prints were needed actually had a post-it note stuck on it telling him his namecheck was done. But the Pittsburgh office isn't very busy and we had been bugging them - they probably wanted us to know there was daylight at the end of our tunnel. Plus they had time to scribble out the post-it message.

December 30, 2005: I-485 received by USCIS

May 5, 2006: Interview at Phoenix district office. Approval pending FBI background check clearance. AOS finally approved almost two years later: February 14, 2008.

Received 10-year green card February 28, 2008

According to a report released in June 2007 by the ombudsman for U.S. Citizenship and Immigration Services , 64 percent of the 329,160 FBI name check cases pending from USCIS have been waiting more than 90 days, and 32 percent are more than one year old. There are more than 31,000 cases that have been pending longer than 33 months.

interesting enough, I received a letter from the senator's office saying that after 3.5 years, my name has been cleared and card production has been ordered... they sent a copy of USCIS letter as well which says the same thing. Sounds fascinating, yet when I called USCIS to confirm the news, they guy on the phone said that he had no idea what I am talking about and my case is in fact still pending!

Go figure:(
