AOS interview successful, but waiting for FBI name check

So would anyone care to make an educated guess what the percentage of name checks that are finished by the time of the interview?

So ..... is it safe to assume that if your hubby/wife waited a long time for the initial name clearance for the visa it will be the same situation for the AOS (with the great possibility of taking even a LONGER time to clear because the person is already here in the states?).........

We waited about 5 months for my husbands name to clear after the visa interview ..... now we are in the AOS stage so I am trying to prepare myself for another marathon wait (uggggggghhhh) ... at least he is here with us now so life can begin to be a little more NORMAL!!!

No, just because you went through AR at the visa stage doesn't mean you'll get 'hung' at AOS.

Likewise, folks who go through AR are just as likely to get their cases transferred without an interview as those who did not go through AR.

What we don't really know a lot about is whether those people who get 'hung' at AOS will also get 'hung' at LOC and NATZ.

:) hopefully things will work out for the best. All cases are different. we have one friend who waited 2-3 years for the visa and then got the greencard within 6 months of coming to the US and filing for AOS. Then there is our case where we waited only 2 weeks after the interview at the embassy and now it has been 3 years....who knows what happens...

I-485 , I-765, I-130: NOA1 : 1/23/2006

Biometrics 2/23/2006

Temporary EAD given for 1 month ONLY b/c of Infopass appt: 5/1/2006

Went back to renew EAD through Infopass: EAD card was not given "due to reasons we can't disclose"

5/3/2007: Confirmation that EAD is delayed due to background checks. (started to use the senator, ombudsman and was just a royal pain in the neck)

5/30/2007: EAD production ordered (after over 400 days of waiting!!! woo hoo!)

AOS Interview: 5/12/2008!!! FINALLLYYYYYYYYYYYYYYYYYYY!!!!!!!!!!!!!!!!!!!!!!

7/29/2008: card production ordered...918 days..can't wait to see that card!

What kind of fingerprint notices did everyone receive and where did the notice come from?

Jon's notice is a single-page document that looks like a photocopy, on white paper. The return address is our local office. As mentioned earlier in the thread, the text of the letter refers to the INS: "To continue processing your application, INS must send your fingerprints..." Apparently updating their own name isn't a priority!

September 20, 2005: K-1 Interview in London. Visa received shortly thereafter.

AOS

December 30, 2005: I-485 received by USCIS

May 5, 2006: Interview at Phoenix district office. Approval pending FBI background check clearance. AOS finally approved almost two years later: February 14, 2008.

Received 10-year green card February 28, 2008

Hi there,

Now I am frustrated, My AOS interview was in August 2006 and the officer said well your case is pending for the FBI check, then in August 2007 after an year I receive a letter saying go to Fedral Plaza & register with ICE (most tormenting thing I ever came across & scary too) ... did a INFO pass and went there after that in OCt 2007 and after seeing 3 officers and waiting for turns wasting my whole day they said ... oh your case is still with the FBI asked me to fill out a form to expedite my case & again I am still waiting ... LOL, NOw I am considering of taking a lawyer and wondering if the lawyer can push or do something?

I received the same letter as AOS Despair. On local letterhead....to the wrong address!!!! At least I got the letter. I have an infopass appt. Hopefully they can figure out my correct address.

Nov 17, 2004 - I-131 approved

Nov 24, 2004 - I-765 approved

Apr 25, 2005 - status inquiry since AOS is 90 days overdue

May 2, 2005 - status inquiry letter to Houston office

May 19, 2005 - had a meeting with the ICE ( they said they didnt know I filed for AOS???)

July 7, 2005 - sent a letter to Senator, Missouri Cis, CIS Ombudsman

July 27, 2005 - letter from Ombudsman - they will start an inquiry into my case.

Sept 14, 2005 - receieved a letter from USCIS Houston that I need to contact Missouri ( from status inquiry)

Oct 6, 2005 - fingerprinting- EAD

Nov 15, 2005 - Received letter from CIS Ombudsman-I need to contact the Houston USCIS

Nov 17, 2005 - Received AP and Ead in mail

Dec 28, 2005 - fingerprinting- AOS

Feb 9, 2006 - Aos interiew- still waiting for background check

Nov 3, 2006 - Second AOS interview, still waiting for background check

Nov 3, 2006 - I-130 approved

Dec 2, 2007 - Fingerprinted again..third time for AOS

Feb 14, 2008 - Received email case approved

Feb 26, 2008 - received Green Card

Ours came on the official form too but from Nebraska Service Center although AOS is pending in Chicago local office.

And it even doesn't have an application number for I-485 only my A number.

To those of you who received the I-797 form, what is your fingerprint code?

"Code 1 is all 10 FP. This is electronically sent to FBI the same day, they run it to match thru their database to match it with criminals/persons of interest and send the results the same day (or the next) to USCIS. Code 1 is very important as it is part of your security/background check and determines admissibility for gc.

Code 2 (index+photo+sign) is for the generation of cards for immigration benefits e.g. EAD, gc etc. If you filed for EAD, you definitely need code 2 or the card can not be generated.

Code 1 expires after 15 months e.g. FBI needs to check their database again. I have had two code 1. Code 2 is done everytime we apply for benefits (EAD- once a year).

Code 3 is a combination of both, when USCIS wants to get a security check done on you as well as generate cards (EAD) for you.

......at the time of gc approval, USCIS sends for a biometrics code 2 again for everyone. those whose FBI security checks have expired (FP taken >15 m ago) will get code 3. A card (gc, EAD) can not be ordered without Photo, sign and index FP."

Ours has code 1.So it's just for updating USCIS files.

But I had the first code1 on Juine 3d 2005 and that file expired on September 3d 2006.Nothing couldn't be done to our case with code 1 expired although we constantly got answers from USCIS that a namecheck was still pending when sent letters to the Ombudsman, our congressman and our two senators.
