AOS interview successful, but waiting for FBI name check

Hi everyone,

Today my husband received a letter from the USCIS in that fancy "green paper" requesting him to go in for a new set of fingerprints regarding his I-485 application. The ASC code is 1. His previous I-485 fingerprinting notice had a ASC code 3. The last set of 10 fingerprints were taken on 3/10/06.

At the end of September, I wrote my senator asking her office to check on our case. Still haven't heard from her office, but I will call her office tomorrow. I don't know if her office's inquiry caused this letter to show up in the mail. I'm not getting my hopes up, but can anyone explain the fingerprinting "code 1"?

My wife has been waiting with a ND of Oct 05 and last friday she went in for fingerprints because she also recieve this fancy green paper but hers said they were expired and it also had a code of 1 which is for only 10 fingerprints. So point out to whoever does the biometrics thats its for the I-485 and its a code 1

because on my wife fancy green paper it had her I-485 receipt number and her first EAD receipt number because we sent them in together in Aug 05 and the guy about messed up because he told my wife it was for her EAD cardand thats code 3 and i caught him and made him check and it was code 1 for all 10 fingerprints just trying to help when he goes in be sure. Maybe this is a good sign they will approve us soon! We havnt heard anything yet as of last Friday. Also my wife wrote to the IO officer that gave her a interview in April 06 and maybe this came from that i dont know. But be prepared and dont miss it.

I think that's what you've been waiting for! I'm guessing that it isn't related to the senatorial inquiry.

I think everyone in this thread who has received a notice to have fingerprints redone has received the green card within a few weeks. (I'm not sure about what code 1 means, but my guess is that it's not a bad thing!) When did you get married? I think your husband should get a 10-year card if the date on the green card is after your two-year anniversary. You must be getting close, right?

September 20, 2005: K-1 Interview in London. Visa received shortly thereafter.

December 30, 2005: I-485 received by USCIS

May 5, 2006: Interview at Phoenix district office. Approval pending FBI background check clearance. AOS finally approved almost two years later: February 14, 2008.

Received 10-year green card February 28, 2008

Hi AOS Despair,

We've been married since September 2005. It's too bad my local office is a 3hr drive from where I live because I would make an infopass appointment right about now. I've decided to wait for a written response from my senator. Her office said it would take them 4-6 weeks to get back to me, and the 6 weeks will be up on Monday.

In my mind, this letter asking for a second set of prints was generated due to the senatorial inquiry but I don't really know. When dealing with the USCIS I choose to be jaded rather than hopeful-maybe it's a gen X thing.

Sand - we have members here that wait a few weeks post-interview all the way up to 3 years and beyond since filing. Stas have shown *many* are cleared by the 6 month or so mark since filing.

There really is very very little you can do to speed up your case (what you can do is based on the off-chance they forgot to submit the namecheck or somehow it got fouled up and they forgot to order your fingerprints and simply call it a namecheck - has happened to dcl on this thread). Otherwise, you wait. The likelihood that you will be stuck beyond a year is pretty slim, but of course, it does happen - just not to a majority of those "stuck".

Hey guys,

Just a quick question; is name-check ordered at the same time (date) finger-print are sent to the FBI?

Because that would give an idea when the name-check was ordered.

The reason for asking - I was able to speak to someone and find out if my finger-prints were cleared (yes,they were sent in, cleared and sent out within 24 hrs after I did my biometrics) and was wondering if the name-check was also ordered on the same day.

Hiya! Just checking in...

We had our AOS interview today and all went well, but the name check wasn't cleared, so I didn't get approved. Our AO showed us the FBI paper saying USCIS requested the name check on November 6 and it came back as "Error". It should have been resubmitted to FBI again by today, he said, but who knows how long it will take before I actually get "No Record" on that piece of paper...

Good luck to all of you already waiting! Hope it won't take much longer!

we cleared my wife's name check on 11/16. went online to the uscis site and saw LUDs. one welcomed her as a new PR.

our timeline: we applied on mach 29, 07. fbi name check was submitted april 5th, interview may 23, name check cleared on 11/16. overall under 8 month..just over 7 months.

just sit back and relax..there's nothing one can do to speed this thing up. my sincere wishes and good luck to all those who are pending...

oh i can assure u i dont sit around worry about it on my mind. i know i cant change a thing but i sure wouldnt go thowing a insult at others who waited way farther then i did. dont u think we have been sitting back and waiting and waiting and waiting. we dont need to be told to do so.

It's also not easy to relax when one is facing $340 for EAD renewal and $305 for AP renewal.

I really wouldn't care as much about the delay except that it's now costing us significant money! And as we've discussed earlier in the thread, the time spent in namecheck delay doesn't count toward the naturalization residency requirement. Some people have been stuck for three years or more, so someone with a similar timeline whose application wasn't held up for namecheck could be a citizen, while the poor sucker in namecheck is still waiting for the green card! And then has to wait three years on top of that for naturalization.

Some people are denied jobs and grants because of their limbo status. My husband was an excellent candidate for a job here a few months back (his boss suggested that he apply), but it required permanent resident status. The list goes on.

It's hard to kick back and relax when all these complications result from the delay.
