AOS interview successful, but waiting for FBI name check

The whole name check thing came as a nasty surprise to my wife and I. I mean we knew that I would have to go through some kind of screening but we never imagined that the USCIS and FBI could conspire to balls up such a simple procedure which is a mere formality in other countries. Since then I have been doing some research on the issue online and I am somewhat heartened that so many other individuals have taken legal action against the USCIS and FBI. We have only been waiting for eight months so I dread to think of how long I will be left languishing. I fear that it is going to take a few years for me as well for several reasons. 1) I was born in Zimbabwe and immigrated to the UK when I was a kid, 2) I legally changed my name when I was 21 for personal reasons, 3) my new last name is fairly common just like my old last name and 4) I no longer have a middle name which really makes things complicated. I have probably done myself no favours with this so I am just hoping that something positive comes out of the lawsuits and media scrutiny. I don't think we could afford to take legal action but we may have no choice but to take that option if things become really desperate.

Still waiting, next month he will have been in this country for 3 years, 2 years 8 months since he applied for AOS, 2 years 3 months since interview. We have done all the right things yet it still keeps dragging on :wacko: Tomorrow is time for another letter to senators office.

7/30/2004 Arrived NVC

8/11/04 Ali received packet from Consular

8/24/04 Ali had interview and was approved

Had to waited 2 weeks for security check

9/15/04 Arrived POE Atlanta

9/28/04 Applied SSN

10/19/04 Recieved SS card

10/25/04 Drivers license (IN requires permit for 60 days)

10/30/04 Married

12/7/04 AOS sent

1/05 Biometrics

5/23/05 AOS interview Approved pending FBI background check

1/06 EAD- (renewed )

AP- applied online took 6 weeks to receive

(we made all the request possible, but were told they could do nothing about how long the FBI was taking)

12/06 FBI background check finished after 2 years

7/07 after 7 months Indianapolis sends request for new bio metrics (made numerous inquiries to NSC and senator)

7/17/07 Bio metrics done again

8/8/07 Received request for further proof of relationship

8/13/07 Bills, photos, letters showing proof received by Indy

9/10/2007 Finally the card production and welcome letter email received

I still cannot believe they would request additional evidence of married life. This is years later! This isnt "another test" - this should have been cleared at the interview!!?? If the only thing they are waiting for is the namecheck to return why why why do they need this other stuff? I just don't get it.

I'm guessing it's because they are going to have to issue a 10-year greencard at this point. But for some reason unknown to us, they are wanting the 'proof' as if journeyhelper were lifting conditions.

Smells like discrimination to me. Or profiling.

Would make a very interesting news story.

Yes we are very disappointed that the Indy office got the FBI background check back in December and it has taken 7 months for them to do anything. We don't really have any problem with them asking for additional proof, it just seems like they could have let them talk to the officer when they went for the info pass appointment on July 17th along with bio metrics. at the appiontment he asked about renewing his EAD but the woman at the counter (who was all they were allow to speak to) said the green card would likely be arriving before the EAD. I think we are at the end of this but it is sure frusturating to keep dragging on.

You should receive your 10 year greencard if the approval occurs 24 months after the marriage.

RJ - I agree that might be the 10 year greencard thing that prompted this, but why would one need to prove twice that they entered legitimately into the marriage... CSC transferees don't need to prove at all, and neither do most LOC applicants. I know, I know - don't try to make sense of it.

I just still think its wrong of them to string them along and request further paperwork of validity just to issue the greencard 10 year or not. I suppose providing bonafides is small potatoes compared, but I was taking it as other's do not have to prove twice they are legit. They already went through the interview process.

Anyway - providing docs to wade through and finally finish should be the focus - and I am focusing on how unfair it is. It just frustrates me.

And it sure is unfair. Which is why I said what I did above about profiling.

it has been a long time since I've heard some good news on this thread... :(

We're still waiting for an interview call or anything...even a darn RFE or something. Called USCIS...was told to get back to them in 6 months...

I am tired of waiting, waiting waiting...

I-485 , I-765, I-130: NOA1 : 1/23/2006

Biometrics 2/23/2006

Temporary EAD given for 1 month ONLY b/c of Infopass appt: 5/1/2006

Went back to renew EAD through Infopass: EAD card was not given "due to reasons we can't disclose"

5/3/2007: Confirmation that EAD is delayed due to background checks. (started to use the senator, ombudsman and was just a royal pain in the neck)

5/30/2007: EAD production ordered (after over 400 days of waiting!!! woo hoo!)

AOS Interview: 5/12/2008!!! FINALLLYYYYYYYYYYYYYYYYYYY!!!!!!!!!!!!!!!!!!!!!!

7/29/2008: card production ordered...918 days..can't wait to see that card!

March 20th 2004 posted I-129f to VSC

March 22nd 2004 NOA1

May 26th 2004 recieved RFE via email

June 4th 2004 recieved RFE in post (photos were not dated, boarding pass had no year on it. oops!)

June 14th 2004 posted response to RFE

June 22nd 2004 VSC recieved response to RFE (dated 18/06/04)

JULY 1st 2004...101 days and STILL counting!!

July 7th 2004 WE ARE APPROVED!!

July 10th 2004NOA2 in post.

July 14th 2004 File sent from NVC to London.

July 28th 2004 Packet 3 recieved

August 12th 2004 sent packet 3 back.

November 1st 2004 Interview date.... APPROVED.

March 8th 2005 Arrive via Bos. Finally see my man again.

May 14th 2005 Our wedding day

June 10th 2005 sent in AOS forms.

August 16th 2005 Biometrics

Sept 6th 2005 Interview - went well....i think.

Nov 7th 2006 STILL awaiting FBI name check!!!!!!!! no green card, no touches, nothing. Getting a bit fed up with being in Limbo land. :0(

January 2007 wrote to senator, who in turn contacted FBI. Yes we are STILL in name check, they got our name in June 2005!!!

February 27th 2007 3 emails all saying the same thing. Fingerprinting processing is completed.

March 20th 2007 Have written to Michael Cannon head of FBI namecheck. Mentioned i am no longer amused :0(

April 28th 2007 Recieved letter asking me to go for third set of fingerprints!

April 29th 2007 Sent a letter to query the need for 3rd set of prints.

May 2nd 2007 USCIS replied - do NOT need a third set after all - go figure
