AOS interview successful, but waiting for FBI name check

Hi, Annett and Sebastien. I'm sorry to have to welcome you to this thread! The information you were given sounds familiar. There isn't anything you can do at this point but try to be patient. It seems that there are relatively few of us who have been waiting longer than a year after the interview. Many more people seem to post stuff like, "Four months after interview, name check cleared! Party!" as compared with, "We had our interview two years ago and are still waiting! Where can I get cheap whiskey and downers?" As you've probably gathered from reading the thread, the worst part is having no way to get useful information. We have contacted our senator, the USCIS ombusdman, numerous INFOPASS people, and my own personal contact who works for the CIS, and everyone gave us the same information: We just have to wait, and there's no way to know when the background check will be complete. At this point, we can safely assume that some aspect of our check is requiring manual record-checking, because it's been 18 months since we filed for AOS. The check could be completed tomorrow, or it could be a year from now. On the good side: This thread is where the hip and groovy hang out, and man, we have reason to kvetch!

Sunnyisland, I'm by no means an expert about the writ of mandamus approach, but from what I understand, the FBI stopped expediting name checks based on WOM unless a condition on a very short list of criteria was met. From what I've read, it's also quite expensive--like, in the thousands of dollars--so unless you think you have a good chance of meeting one of the conditions, you're probably better off just waiting despite the massive fee increases for the EAD and AP. An unsuccessful WOM might just send you over the edge. Wikibooks has a good page on the immigration WOM, to include links to USCIS memos on the subject: http://en.wikibooks.org/wiki/FBI_name_check

Yours in despair,

Julie

Thank you so much AOS despair--I guess I am so used to be organized and this is making me crazy not to have any control. I will research further, but the frustration continues for us because of the limitations with financial losses due to pending status. I wonder if anyone has had a UNSUCESSFUL WOM as well.......Any feedback is deeply appreciated.

Timeline
We have been 14 months since they were sent to the FBI and 11 months since his interview. There is nothing to do but wait believe me, even a senator cannot move them. Yes he is from a North African country but I saw someone else on this board with a long wait from Scotland, and someone else from Morocco who got theirs right away so it doesn't make much sense.

We were in the same situation. We were verbally approved on 8/29/2006 - pending a background check. We wrote to our senators and congressman, I actually think that that helped. The USCIS 800 number was useless - don't waste your time.

After writing to our senators and congressman, we were approved and received our G/C within a few weeks. I suggest trying this step.

well we finally got a letter back from the ombudsman. totally worthless. another, give us 45 days to check into it and we will let u know. in other words....ur in fbi check and nothing can be done to expidite it. just wait it out.

the problem is they check with the uscis which of course is the same thing as making an infopass appointment and they look at the computer screen and say..fbi check pending. of course the fbi dont update them on anything so thats all the info they have.

the problem is in the fbi. no one inquires to them and they are the hold up.

so checking with uscis is worthless cuz without fbi updates they are in the dark too.

so much for writing to the ombudsman.

being touched just means when u have a online account with the uscis to check on the status of ur case something changes. sometimes just the date changes and sometimes u get an email saying uve been approved or in my case...ur fingerprints have been recieved and we are processing ur case.

ok soooo - after speakin with da Ewok - we came to the conclusion that the best way to trim the thread of bumps and other unnecessary stuffs would be to split out the informational posts and to let the bumps die a natural death :D... this is a big thread. anyone want to volunteer to go through it with me? I have already gone through posts 1-140 and figured out what probably could be eliminated... anyone else game to help a poor gal out?

:D

I'll help. When ya wanna do it?

So far I have gotten up to post #300... I am writing down all the numbers of posts that will STAY - ie - informational posts, etc. I am trimming some of the "extra" member listings as well - at times there were 3 or so posted on on page, so I am cropping that back as well.

Just provide me with the post #'s that are to stay within the range you select - (ie ~ would you be willing to do posts 600-900?) A little helper that has been useful is I have turned off siggys so it makes it easier to zip through. Let me know what you think and I will continue on.

So....we are taking out what? Daily musings and grumbles, the "I finally got it"s and leaving what we've learned? Is that right?
