Take my name out of the list, guys... After four months after interview, security checks are cleared! I'm really happy for not having to wait too much! :P

Went and did the supposed last biometrics . They said it is approved but just needed the biometrics since they were outdated. Then they said it may be 45 days before we hear anything. I hope not! Monday will be 2 weeks since he was there, so if nothing has changed by then we will contact the senators office again.

I guess this is going to just keep dragging on and on :crying: its only been 2 plus years since the interview!

Biometrics 2/23/2006

Temporary EAD given for 1 month ONLY b/c of Infopass appt: 5/1/2006

Went back to renew EAD through Infopass: EAD card was not given "due to reasons we can't disclose"

5/3/2007: Confirmation that EAD is delayed due to background checks. (started to use the senator, ombudsman and was just a royal pain in the neck)

5/30/2007: EAD production ordered (after over 400 days of waiting!!! woo hoo!)

AOS Interview: 5/12/2008!!! FINALLLYYYYYYYYYYYYYYYYYYY!!!!!!!!!!!!!!!!!!!!!!

7/29/2008: card production ordered...918 days..can't wait to see that card!

Hi, everyone. I thought I'd drop in and say hello. I was rather excited a couple of weeks ago because my AOS profile was touched on July 12, the first update in eight months. Alas, nothing has shown up in the mail--I was hoping for the ever-popular re-fingerprinting notice. Oh, the despair.

March 7, 2005: I-129F NOA1

September 20, 2005: K-1 Interview in London. Visa received shortly thereafter.

AOS

December 30, 2005: I-485 received by USCIS

May 5, 2006: Interview at Phoenix district office. Approval pending FBI background check clearance. AOS finally approved almost two years later: February 14, 2008.

Received 10-year green card February 28, 2008

Hello everyone

THis is our first post on this board, but we have been reading it quite often.

Anyhow, we wanted to add our two cents.

We had our OAS interview in Atlanta this morning. The interview was fairly quick, the officer asked about 5 questions, and made copies of our house deed and bank statements and say :"you are approved", so I was getting excited then she said BUT we did not get your last background check back yet.

So of course I am thinking back of this forum and of what our lawyer told us the previous week, that is pretty much one of the worst thing that can happen since no one knows when it will arrive.

I asked her for a timeline and she said as soon as it arrive, since we are approved, they will send us the green card, but no one can know how long it will take. She did not seem too worry about it, but said that I have to wait 6 months and get an INFOPASS appointment if I want any updates, but not to do anything before 6 months as no one will have new info

So I guess the waiting game starts.

I talked to our lawyer as soon as we got home and she said the same thing, just wait, but she did say that our interview came really fast and we did not have 120 days since our biometric so just to be patient!!

So if you do not mind we will come and wait on this board with everyone else in the same situation

Thats fine Lal Brandow! we need to keep this thread alive at least every week so it doesnt get lost like our namecheck...lol...

Also, I know this had to be mentioned elsewhere, but has anyone filed a WOM for AOS residency. This is really starting to get to us!!I am losing scholarships, financial aid, loans, etc. just because I dont have that green card yet. The authorities dont seem to care that I have been approved "pending name check". THey just want to see that green card!

The lawyer said this is our only resort.

Ombudsman is not doing anything, just got standard response letter just like USCIS sent out before. It has been almost TWO years since our interview.

Congressmans office is just not even answering us anymore...any suggestions for next step beside patience..patience...patience.....................................

I didnt know if WOM has been tried by anyone here; I figure the cost will start making sense because of all the USCIS increases now. Already paid for EAD, (4times) AP, etc.....

Hi, Annett and Sebastien. I'm sorry to have to welcome you to this thread! The information you were given sounds familiar. There isn't anything you can do at this point but try to be patient. It seems that there are relatively few of us who have been waiting longer than a year after the interview. Many more people seem to post stuff like, "Four months after interview, name check cleared! Party!" as compared with, "We had our interview two years ago and are still waiting! Where can I get cheap whiskey and downers?" As you've probably gathered from reading the thread, the worst part is having no way to get useful information. We have contacted our senator, the USCIS ombusdman, numerous INFOPASS people, and my own personal contact who works for the CIS, and everyone gave us the same information: We just have to wait, and there's no way to know when the background check will be complete. At this point, we can safely assume that some aspect of our check is requiring manual record-checking, because it's been 18 months since we filed for AOS. The check could be completed tomorrow, or it could be a year from now. On the good side: This thread is where the hip and groovy hang out, and man, we have reason to kvetch!

Sunnyisland, I'm by no means an expert about the writ of mandamus approach, but from what I understand, the FBI stopped expediting name checks based on WOM unless a condition on a very short list of criteria was met. From what I've read, it's also quite expensive--like, in the thousands of dollars--so unless you think you have a good chance of meeting one of the conditions, you're probably better off just waiting despite the massive fee increases for the EAD and AP. An unsuccessful WOM might just send you over the edge. Wikibooks has a good page on the immigration WOM, to include links to USCIS memos on the subject: http://en.wikibooks.org/wiki/FBI_name_check

Your are right, this is probably the last thread were we wanted to post, but oh well, all we can do is wait!!

I am sure you are way more frustated than us, since you have been waiting for so long, but this is 2007, one would think that the system would be better and more efficient. I almost think they should not give you a AOS interview until the FBI name check comes back, that way, you know that once you pass the interview you are done for good!! Anyhow, just my two cents, I am sure we will talk on this forum many more times!!!
