AOS interview successful, but waiting for FBI name check

Our Namecheck started on Oct. 8th, 2003

Filed for I-485 AOS 7-12-04

File went to FBI for Name Check on 10-08-2004

AOS interview 2-16-2006

Told that AOS approved "Pending Name Check"

Refiled for EAD 12-12-2006

EAD approved 3-04-2007

I-131-AP filed 2-18-2007

I have written both Senators of my state with no luck.

I have written my district congressman with no luck.

They all say it is out of their hands.

I even wrote GW Bush a letter asking for help , but got no reply.

11/21/06......Checks cashed, NOA1 for I-130/I-1485/EAD arrives in mail (Day 8)

12/12/06.... Biometrics done (Day 29)

01/20/07...Interview notice received dated Jan. 12, Yay!! (Day 68)

01/30/07....EAD touched, finally!(Day 78)

02/01/07....I-485, I-130 touched. EAD card production ordered (Day 80)

02/07/07....EAD card received in mail (Day 86)

02/26/07...Interview - name check pending (Day 105)

06/21/07.... Card production ordered email...omigosh! (Day 220)

06/24/07.....Email: Notice mailed welcoming new permanent resident on 6/22

06/30/07.....Welcome notice received in snail mail

letter received today from our congresswoman - FBI namecheck ordered on 11/14/2005 (couple weeks after our NOA).

Status: Pending.

oh and hubby just re-entered the US through JFK (on the phone now) with AP and was absolutley no problem. :dance:

Why do you think some people posting on VJ are being told by senators and the like to not use AP because it is risky? Your beloved used it without problem, and when hubby and I went to the UK so see family, we had no worries using it on the way back either.

I guess the train of thought might be what difficulties you might face if you are approved while out the country on AP as (theoretically) when you get your Green Card, you don't need your AP any more and it might likely become invalid. But then, why approve and interim benefit that lets you travel if you are then penalized for using it because you weren't psychic enough to work out that your GC would be approved while you were away.

Anyhoo, just thought I'd throw that out there...

my guess would be that if USCIS can screw up the minute details we see everyday, this *may* be one of those issues, although I have yet to see anecdotal evidence supporting the fear, so I think the discussions are more cautionary than anything. You are parolled in, and I suppose thats a wee bit scary if you really think about it.

(oh and it wasn't only the AP we were concerned about - it was also the no-fly list since he is flagged)

I've read about people who have overstayed previous visas being advised to stay put until GC arrives. I guess that's no fun when you're in for an indefinite wait. The whole AP thing is preposterous, when you think about it. Which I try not to or I'll fly into a rage.

September 20, 2005: K-1 Interview in London. Visa received shortly thereafter.

AOS

December 30, 2005: I-485 received by USCIS

May 5, 2006: Interview at Phoenix district office. Approval pending FBI background check clearance. AOS finally approved almost two years later: February 14, 2008.

Received 10-year green card February 28, 2008

my guess would be that if USCIS can screw up the minute details we see everyday, this *may* be one of those issues, although I have yet to see anecdotal evidence supporting the fear, so I think the discussions are more cautionary than anything. how the heck did he get on the no fly list and when did that happen?

hassan wants to travel in two weeks and im trying to talk him out of it. his AP expires at the end of june and if his ex causes problems like she used to and keeps him detained there he will be in big trouble.

it happened in the last few months, but it really isnt as big a deal as it sounds (except that he travels ALOT). he just has to go for a secondary screening i believe and get "cleared". lots of innocent people are flagged due to similar names and the like.

oh ok, ive heard of the no fly list but ive never heard of anyone being on it. when hassan traveled last year he didnt have any problems so i forgot all about it until u said your husband was on it.
