AOS interview successful, but waiting for FBI name check

My case has been transferred to CSC and I was just wondering out of curiosity if anyone with the last name of MARTIN is on the pending FBI namecheck list, that is my maiden last name and my married last name is LAKE. Not sure which last name they check up on?

I'm sure there are.

It's not just your last name they check. They check phonetic derivatives of your name; they check your name turned around different ways; they check your name even without the last name on it.

So it makes no difference if they check maiden or married name, save for it might add a few more 'checks' to the list if they do both - which I imagine they might.

Today I called the ever-helpful CIS customer service line because it's now been six months since we (actually, 'da husband) received the letter that says to call if no action is taken in six months. I don't expect anything other than another letter that says the same thing, but the guy I talked to said something like, "Sorry this is taking so long." This was the first time anyone associated with immigration has suggested that maybe it is indeed taking a while. Every other time, we got the usual, "Well, there are a lot of other people in the same position," and "Some people wait years!" as if I give a $#it about those other people. (OK, I'm a sensitive person, but I have my limits!)

I'm not sure that is terribly encouraging, but I thought I'd pass it on! Maybe when a solid year passes after the interview with no movement on the case, they start to acknowledge anxiety/annoyance just a little bit. Or at least not give us dismissive replies as if we're being impatient kids in the water fountain line after gym.

May 5, 2006: Interview at Phoenix district office. Approval pending FBI background check clearance. AOS finally approved almost two years later: February 14, 2008.

this letter was in response to our written inquiry to the USCIS Assistance Office, they, in response to my letter from January CALLED Del with the update (or lack of) in April. This letter is just the written response. they put lots of pretty attachments in the envelope too, how sweet. contact information below.

So I got 2 letters, one last week from USCIS and one this week from USCIS..both saying the same thing but in different language. They acknowledge that the I765 is taking FOREVER but they say ALL APPLICANTS undergo the security clearance for this benefit. I say it is bulls-h-*-t

Temporary EAD given for 1 month ONLY b/c of Infopass appt: 5/1/2006

Went back to renew EAD through Infopass: EAD card was not given "due to reasons we can't disclose"

5/3/2007: Confirmation that EAD is delayed due to background checks. (started to use the senator, ombudsman and was just a royal pain in the neck)

5/30/2007: EAD production ordered (after over 400 days of waiting!!! woo hoo!)

AOS Interview: 5/12/2008!!! FINALLLYYYYYYYYYYYYYYYYYYY!!!!!!!!!!!!!!!!!!!!!!

7/29/2008: card production ordered...918 days..can't wait to see that card!

Lal, thanks for the address. I hadn't heard of the Immigration Assistance Center. I did send a letter to the USICS ombudsman about a month ago, but I haven't read of too many people having luck with that route. It can't hurt to try something else. Plus, we didn't get any perty pictures!

zsam, that's so weird that they won't issue you an EAD. I don't think I've read about that happening to anyone. It must be absolutely maddening.

Sheesh.

Don't they get it? The process DOESN"T work, thats why we are still waiting almost two years later.

i have been sent so many of these damn sheets i could wallpaper my bathroom with them. How appropriate.

Sorry, just venting - got another one today and still nothing. We are heading 23 months now.

JULY 1st 2004...101 days and STILL counting!!

July 7th 2004 WE ARE APPROVED!!

July 10th 2004NOA2 in post.

July 14th 2004 File sent from NVC to London.

July 28th 2004 Packet 3 recieved

August 12th 2004 sent packet 3 back.

November 1st 2004 Interview date.... APPROVED.

March 8th 2005 Arrive via Bos. Finally see my man again.

May 14th 2005 Our wedding day

June 10th 2005 sent in AOS forms.

August 16th 2005 Biometrics

Sept 6th 2005 Interview - went well....i think.

Nov 7th 2006 STILL awaiting FBI name check!!!!!!!! no green card, no touches, nothing. Getting a bit fed up with being in Limbo land. :0(

January 2007 wrote to senator, who in turn contacted FBI. Yes we are STILL in name check, they got our name in June 2005!!!

February 27th 2007 3 emails all saying the same thing. Fingerprinting processing is completed.

March 20th 2007 Have written to Michael Cannon head of FBI namecheck. Mentioned i am no longer amused :0(

April 28th 2007 Recieved letter asking me to go for third set of fingerprints!

April 29th 2007 Sent a letter to query the need for 3rd set of prints.

May 2nd 2007 USCIS replied - do NOT need a third set after all - go figure

Doodles, that's a real drag. You've been waiting even longer than we have! You're right, the convoluted process that the FBI is using certainly is not working. Someone on a related thread mentioned that there seems to be a disproportionate number of UK and Canada cases stuck in the background check. I'm not sure if there is anything to it--it seems like there is, but that might just be reflecting the demographics of people who use this site. I copied this text from the FBI Web site:

Since June, 2002, the FBI has been able receive visa applications by automatic uploading of Department of State cables. Visa request information from the cable is parsed and placed in a server for transfer to the FBI's National Name Check Program (NNCP). Parsed information is run against the FBI Universal Indices (UNI). The searches seek all instances of the individual's name and approximate date of birth, whether a main file name or reference. By way of explanation, a main file name is that of an individual who is the subject of an FBI investigation, whereas a reference is someone whose name appears in an FBI investigation. References may be associates, witnesses, co-conspirators, or victims whose name has been indexed for later retrieval. The names are searched in a multitude of combinations, switching the order of first, last, middle names, as well as combinations with just the first and last, first and middle, and so on. It also searches different phonetic spelling variations of the names, especially important considering that many names in our indices have been transliterated from a language other than English.

So, given that the FBI database presumably contains the names of people in the U.S., it stands to reason that a lot of English names are in the database. But who knows? It's really dispiriting.

Hey, it's ok to vent. I haven't been waiting as long as you have, but I swear some days I feel like screaming! So, go ahead and let it out. I'm just giving USCIS one more month, before I start venting on here. <_<

Well here is another vent. We waited for 2 years for namecheck, found out recently that it was finished last December. Which means our local office has been sitting on it for 5 months. Yes we have contacted our senators office and they said it is in ajudication and we should hear soon. The NSC sent a letter promising we would hear something by May 8th but of course nothing. So here we sit waiting still.

That's terrible! At least they're working on it now. I guess you really can't leave anything to change, and it pays to be in their face even if they turn you away!
