AOS interview successful, but waiting for FBI name check

So I called USCIS and spoke to an immigration officer, explained our delay and problem with biometrics, and he is having our case "referred" to see what is going on.
He said hopefully a new biometrics appointment will be scheduled and/or this "will light a fire" under the Chicago office to get Carina's AOS app approved. His own words:)

I am confused, why does the officer think this will help? If the other agency (FBI) is not done with a file, then they are not done. USCIS supposedly expedite a case because the processing dates are after a certain time. I am not sure what kind of pressure they can put on the FBI to hurry up as it is documented FBI name checks come in on a 1st in 1st out basis.

I may be way off base, but I have gone through FBI checks prior to getting our K1 and there was absolutely nothing the consulate/DOS could do.

You must have missed my previous post (also see our timeline); FBI is not the issue, USCIS is. FBI has written to us that Carina's namecheck (and biometrics) request have NEVER been received from USCIS. Carina's age (she was 13 when biometrics were taken in December 2004) is the problem most likely, so her app has just been sitting on a desk somewhere waiting for some action to be taken.

This is why I urge others in the same situation to be sure their biometrics and name check request have actually been submitted to the FBI, as opposed to just waiting for it to clear. What worked for us as far as getting a response from the FBI was a status inquiry letter to the first lady Laura Bush.

ahhh gotcha. I was focusing on the 30 days past processing dates as a catalyst for getting help with the FBI not 30 past processing dates to inquire about the petition. what #######. so if an office is hopelessly behind... you may have to wait 2 years to inquire??!! what a joke.

well at any rate, I am glad you were able to get some assistance from the officer! Keep us posted and sorry for the misunderstanding!

edited to add : my local office is working on April 2005, so it will be awhile before we can inquire.... hopefully we will be approved before then!

Going back to a question asked on this thread about when the name check is actually initiated by USCIS. My biometrics were completed on 04/05/06 and I now remember our interviewing officer saying that it usually takes 2-3 months for the name check results to come back (at least in Buffalo). And then said something about it having been since 04/04/06 for mine, so maybe they'd be back in, but they were not. It would help a little I guess if we knew exactly when the name check is initiated. Also, I sent an email to Laura Bush on 06/08/06, but still have not heard anything yet, so hopefully we will soon.

Rebeccajo, how funny that you should refer to us as being in the "black-hole", because I just talked to my attorney today about this pending FBI name check and she also said that Immigration attorneys refer to people in our situation as being "black-holed". I had never heard the term in reference to this before now. She also confirmed that FBI name checks usually take a few months, but of course there are cases that take longer, such as someone having a common name, previous arrest, etc, or who knows what else.

I'm getting way tired of it. If the check is ordered after the biometrics are taken, then it has been six months tomorrow for Wes.

My current plan is to wait till August. I will e-mail Pittsburgh one more time. If I get another one sentence, six word reply that says 'still pending' I'm calling Senator Robert E. Byrd's office and writing to the first lady.

We are trying to sell our home and looking to buy another one. We can't get a decent loan rate without a green card. I'm starting to get pissed.

Well my son's and my Bio's were done on the same day. So I cant figure out why his name check isnt back and mine was. Thats just stupid. He's only 17, how much checking do they have to do on a minor.

We had our Bio's appointment on Feb 22. So it was three months after they had our Bio's done, before we had our AOS interview in Atlanta on May 17th.

Still in the black hole too, however I've received a request for another biometrics appointment this Thursday. I guess they think my fingerprints have changed since December.

hi, guys! well, as of yesterday, we too can join the black hole waiting list. :huh: i'm not sure if we should be happy that we're approved, pending...or scared and frustrated that we might wait forever.

anyway, our dates...biometrics April 19, 2006 interview June 20, 2006 approval and GC pending, of course.
