Hello,

 

My wife and I are about to file for the Adjustment of Status, and I know that I have to provide tax information. I am behind in my taxes and am sending those in to get filed, however, I am just wondering if I can go ahead and file for the AOS using my current W2's as my proof of income? Or do I actually have to wait for the IRS to send back any information? Any assistance and advice would be greatly appreciated, I thank you all.

If you have not yet sent the 2017 tax return, you need to include the tax return extension application for your AOS. Including 2017 W2 doesn’t hurt. Then provide 2016 tax documents or trancript.

what about prior years tas transcripts and evidences of current income? W2 is not the proof of current income.

They are needing more information from you. I received an RFIE and I sent in W2s, past two years (2015, 2016) tax transcripts, pay stubs, job letter and bank statements. In the response I included a copy of the 2017 tax return as the transcript was not yet available. So far we haven't received anything else. But yes you'll need to send more than just W2s.

Directly from the USCIS website:

 

"A copy of individual Federal income tax return, including W-2s and 1099s, for the most recent tax year, or evidence that they were not required to file."

 

If you efile, you have access to your transcripts 2-3 weeks if no refund or balance owing unless you had a balance owing and paid when you filed.

So then I have another question. (I'm sorry for asking so many) I've seen and heard that your 1040 is your personal tax return. So can I just make a copy and send the AOS at the same time as I send the IRS my taxes? I'm basically trying to find out if I have to wait another few weeks for the IRS to get back with my tax info before I file or not.

I sent my AOS last nov 2017 with w2's only from 2014-2016. I received an RFE 1st week of Apr and they asked for the recent federal income tax return. So since the filing was just over apr 17, i cant provide a transcript yet. So crossing fingers, i just sent a copy of 2017 W2 and the copy of 1040EZ as a proof that he filed the recent year. If i were you, just wait til you gather all the requirements before sending the AOS application. Coz if you get an RFE, it will be the same. You will wait more.
