Hello good people.. Please I need your good advice on my case.. I marry my wife on November 2016 and we about to file in this year... We already paid a lawyer to do it for us and they lawyer have complete filling the form... We only need to sign.. The day we about to sign my wife get arrested by police warrant for like different charges.. Forgery, jumping of bail, driving while license expired.. Please is it advisable to go ahead with the filling or I should hold on for her to come out.. Is it going to affect my case.. Please I need your professional advice.. Thanks

you have nothing in reference to your timeline. what visa type? are you the beneficiary or petitioner? with those charges....i am no lawyer but it sounds your chances are slim to none, just by the few clues you are giving

10/21/2018                Card was mailed to me, and yes it said so on a Sunday night, while Vj-ing

10/22/2018                Card was picked up by the USPS

10/24/2018                EAD in hand. F%^&& finally

12/28/2018                Interview has been scheduled. Waiting for notification with date by snail mail

Is your wife currently incarcerated? Is she facing significant jail time?

 

If so, this is likely going to delay your ability to file based on marriage to her. She will need to clear up her legal problems. What does your lawyer say?

It is nice that you are not the one who committed those charges but those are some serious charges. You said you have a lawyer. I think he is probably the best person to help you with this matter.

Unless the Nigerian OP is quite wealthy, they are silly to apply for a visitor visa, when already married to a US Citizen.  For a spouse visa (more likely since a lawyer is involved) the US citizen's arrest is of no concern unless they go to jail and don't qualify as sponsor.  ASK the ATTORNEY.
