Will my husband needs to file a waiver???

Hi everyone! I have a situation any input will surely help...before I met my husband, he had travel to Mexico then went to Mexicali border and asked for refuge. His demand was denied and then after a few weeks in the US he was sent back to his home country. We met two years later and got married.  We applied with uscis and was approved in 4 months and now our case has been transferred to NVC about a month ago.  I’m now stressing out thinking about when it come time for the interview process that we might ask to file a WAIVER(I-601). I was wondering,  since he went himself and asked for refuge, I’m thinking maybe this is different to as if he was apprehended by US Border patrol. Are there anyone out there encountered this situation??? Help, help, help  Pleeeease!!! Because I can’t wait to have my husband here with us in the USA😔

Is your husband currently in the US or Mexico? Also, has your husband ever been illegally in the US for 6 months or more?

My husband is currently in Haiti. He has never been to the USA, except for that one time he traveled  from Brazil to seek refuge to the USA through Mexicali border and there he was denied/apprehended and was sent back to Haiti a few weeks later in 2016.Thanks for your replying...I really appreciate it!!!

Hmm... I am not sure. It seems to me that he may NOT need to request a waiver, because he has never been in the US.

What I understand is, he presented himself to a point of entry, requested refuge, was denied and returned to his home country.

Check with a lawyer, just to be sure.

Hi! We got the case/invoice number today and the representative said we should receive the welcome letter soon...I’m so excited🙏🏽🙏🏽🙏🏽
