I didn't think getting a work visa would be so complicated. I didn't think the employer would have to pay for it, I mean I am willing and capable of paying the cost.

It doesn't work like that. An employee has to apply for you and they pay the costs. They also have to show the US government there is a need to higher a person from another country because there aren't any qualifying Americans that are willing to do the work.

 

It is a big misconception to most but obtaining a work visa is very difficult.

work visa also not a fast process

BTW   even if you have complete custody,  need persmission from other parent to bring into the US

a lot of stink was made years ago when a child was here with one parent and the other side of the family sued to have the child returned to home country 

they won the lawsuit

if u already talked about marry and u want be together u can do K1 or CR1 (i would recommend CR1), cheaper and u can work! a few months more but u are nearby and can visit while waiting :D:D 

I agree with the comments before a ring is just symbolical.

Only you and he can decide which is better for you.  Based on what I read in this thread, I would consider either A K-1 fiance visa or a CR-1.  This is my comparative analysis:

 

K-1

    More expensive than CR-1

    Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)

    Spouse can not leave the US until she receives approved Advance Parole (approx 3-4 months)

    Spouse can not work until she receives EAD (approx 3-4 months)

    some people have had problems with driver licenses, Social Security cards, leases, bank account during this period .

    Spouse will not receive Green Card for many months after Adjustment of Status is filed.

CR-1

    Less expensive than K-1

    No AOS required.

    Spouse can immediately travel outside the US

    Spouse can start work if desired

    Spouse receives Social Security Card and Green Card withing 2 or 3 weeks after entering the US

    Spouse  has legal permanent Resident status IMMEDIATELY upon entry to US.

 

All-in-all, the CR-1 is superior to the K-1 imo.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Sounds like you need a K1 and K2 visa. With the K1, you have to marry your boyfriend within 90 days of arrival. The K2 is for your child. When applying, you have to state your intent to be married within 90 days of arrival in writing.

 

Once you are married and you adjust your status, you can apply for an EAD card. This allows you to work while you are waiting for your permanent resident card (green card).

 

The CR1 can take longer and you obviously have to already be married. The employment visa has to be sponsored and your employer has to prove that they need to hire you over an American.

About 2-4 weeks normally, and the date is normally a month from the day you receive notification.  

But it depends on the embassy or consulate.

I know you said you have sole custody but the father still has rights whether he uses them or not. It sucks  I know, but in Canada it's almost next to impossible to strip the other parents rights away. So get a court order or permission. I went with a court order because my lawyer didn't trust that my ex wouldn't try something.

Legally he still has rights as the biological father....always best to get a court order to move the child out of the country permanently.

You still need something legal. Otherwise anyone could just arrive at the embassy and claim that the other parent doesn’t want rights whether or not it’s true.
