Last name change after marriage, K1 visa

Timeline

Do I write my NEW last name in all the forms required for AOS ( like I-485, I-693 etc.) after getting married ? All my documents like passport, SSN, visa are with my Maiden name, not sure how to do that properly, as Green cars eventually has to be with my NEW last name, not the old one. Thank you for helping out

I can't say with certainty this is the best way to do things - but it is how I did it, and I had no problems what so ever!

 

I filed AOS with my NEW married last name. I also went to the Social Security office with the marriage certificate and changed the name on my SSN card (keep in mind the new card of course still had the not valid for work without DHS authorization stamp on it). When I got the EAD/AP combo card with my NEW married name, I then went to get a drivers license (Ohio), in my new married name and also went back to the social security office to get a card without the "not valid for work" statement.  Then finally after all that I decided to change my passport so that everything matched up! But I have seen many many people not change their passport right away and just carry around a certified copy of the marriage certificate or abstract when they travel since the green card will have married name but the passport will have maiden name.

All you need is the certified copy of the marriage certificate, which you will have to submit anyway with AOS :) This is enough for them to produce the green card and EAD/AP combo in your married name.

All you need is the certified copy of the marriage certificate, which you will have to submit anyway with AOS :) This is enough for them to produce the green card and EAD/AP combo in your married name.

Yes I used my new married name on everything even though my ssn and everything else including passport was still in my maiden name. Everything worked out okay as long as you attach your marriage certificate :)

what we did is right after we got married we went to Social Security and changed her name on that with our Marriage certificate, took about 1 week to get new card, and used that when we filed our AOS, EAD & AP.

K1 visa adventure 

02/20/2017- I-129F packet send to Dallas

02/22/2017- I-129F packet delivered

02/28/2017-- check cashed

03/01/2017-- NOA1 text and email received transferred to (CSC)

03/06/2017-- NOA1 hard copy received in the mail.

05/23/2017 -- Notified RFE

06/16/2017 -- Replied RFE

06/19/2017 -- CSC Received reply

06/26/2017-- Approved 

06/30/2017-- received NOA2

07/10/2017-- NVC Recived case

07/11/2017-- Case number assigned

08/14/2017-- Interview ( APPROVED )

 

AOS

11/29/17- Packet sent to Chicago lockbox ( I-485, I-765, I-131 included)

12/1/2017- recieved packet

12/6/2017 NOA1 text and email recieved

12/8/2017 NOA1 Hard copy recieved

12/26/2017 Biometrics done

03/31/2018 RFE - I-131

04/19/2018 Approved I-765, I-131 ( EAD & AP )

04/26/2018 Received combo card in mail

12/06/2018 Interview done - no decision

12/27/2018  APPROVED - card being produced

Doesn't matter, the marriage certificate functions as a legal name change document in this case.  Our marriage certificate was similar, but my wife changed her name on all the AOS forms.  Now making a change in your Ukrainian passports may be another matter, but you can look into that in the future.

The marriage certificate is always in the maiden name or name before the couple got married.

 

After we got married my wife started using my name on everything as well.

Hi, i am not sure if you still go on this forum. I have the same question, wanna ask you the result. I am filing for my green card, but my marriage certificate is still with my maiden name on it. I don't have any other doument to approve my marriage name. Just wanna know if everything went well on your end. you got your green card with you marriage name?

File the AOS in the name you want to use.
