K1 visa cosponser needed. Cosponser is on disability does not file taxes what info does she need from irs

Hello I don't make enough to sponser my fiance for k1. My mother has agreed to cosponser. She is on disability but does make enough to cosponser. Im trying to find out what exacly does she need for the affidavite of support since she doesn't file taxes? Im an April 2018 filer thru Moroccan embassy. Thank you.

If she makes over $25,000 a year on SSDI and she is single ($32,000 if filing jointly) then she must file taxes. To be your joint sponsor (your spouse is always your sponsor) she must be making about that at least? 

 

Filing taxes isn't the same as paying taxes.

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

No she makes $18,000 she lives alone. So she qualifys. Her paperwork says she is not required to file taxes. So does she just need a letter from the Irs or what?

She will make enough for the 134 but not enough to help with the 864. What will you do then? You arent going to be able to AOS your spouse... 

 

Anyways she just sends a written statement saying she is not required to file taxes with her proof of income

The SSA 1099 statement she gets every year should list if she is required to file or not. 

 

As stated above, it's not enough for AOS, just the k1. Better give this some more thought.

ICE home visit, schedule time to go to DHS office and NTA issued, date TBD, was not detained and released on own recognizance within an hour: January, 2015.

NOA1: Feb. 20, 2015.

Transfer to CSC to balance workloads: August 2015

1)First Master Calendar Hearing: Sept. 9, 2015-Continued based on pending i-130, new court date in 6mo.

Congressional Inquiry: Dec 8. 2015

***i-130 APPROVED WITHOUT INTERVIEW: Dec. 21, 2015** :dancing:

2)Second Master Hearing: March 9, 2016- Removal proceedings terminated w/o prejudice based on approved i-130!! Remanded to USCIS to begin AOS process :dance:

Inquiry about case status: Sept 2016- Case pending interview at local office.

Inquiry about case status again: Oct. 2016- Due to factors not related to your case, anticipate a delay in processing

$18,000 doesn't appear to be enough to qualify because she must include the immigrant she is sponsoring, as well as you if you are a part of the household as well so the household then is 2 or 3.

 

Even at 2, the 125% mark is $20,575

Im working on finding another cosponser and also Im working my booty off to try to make enough for 2018 year. Im only 5,000 short from 2017 tax year. So frustraiting.

No I live seperate from her so im not included. She would just put her and him. I was told that she qualifies for k1 so she is ok to do k1. I just need someone for aos but im trying to make enough so I wont need someone to cosponser for aos

She meets the bare minimum, although the CO gets to make the final call on the public charge concern based on the totality of the circumstances. My opinion is that a CO may make a determination that the co sponsor may not be suitable to address this concern in this particular situation. I would suggest finding a new co sponsor before the interview, if at all possible, just in case. They'll be needed for AOS anyway.

Yes im trying to do that. Its not easy. I have time still.

for years my mom went and had her taxes filed out and finally someone said "you don't need to file"

 

now for you as to getting the K1 approved in Casa, your chances are very slim

We went thru a 6 year process to be approved

 

i will be blunt so please forgive me

but the embassy is tough / they will want you to have multiple visits and Quality time (not just a 10 day vacation)

for instance they only approved 17 in 2017 from August 2016 to August 2017

at the interview  your financee will be hit with these concerns:

they will question your income

your length of stay and number of visits

they will question how you paid for the visits as your income does not meet the bare poverty quidelines

if you are young and still are child bearing age, they will question how you can afford children and point out that is an additional expense you need to prepare for

your mother is not making enough to qualify on her own / need both yours and hers if living with her /  not living with her there are living expenses for 2 domicles counted in their review of the application

they do review the application before the interview and not much financee can say to change any decision

they may not even allow the mother as cosponsor

good advice is to get a second job and save for another trip to morocco to marry

 

to be approved in Morocco you need to:"make several visits

spend quality "face time"

best advice is to marry there and do the CR1 as the K1 is more expensive

fees for K1 application fee, visa application fee DS 160,  fee for I 134 support agreement ,  then the visa fee of $165 and AOS fee (if visa granted ) of over $1200 after marriage in plus medical exam,  traveling for interview,  getting all documents translated from Arabic to English and plane fare to US

you still have some of these with a CR1 but not the AOS big fee and the green card (if married) comes fast so the person can work in the US

 

We wish you good luck but your case is weak at this point

You dont know me or my case so dont tell me my case is weak. Talking about finding a sponser says nothing about anything else. So don't say things you know nothing about. I know all the fees and im paying it all on my own thank you very much. I have been to Morocco several times over the years. We have alot of time together.

I said your case is weak from what you posted

and you say you made many trips 

casa will question how you were able to do this on your income

As i stated my comments would be blunt

and it was not to offend and you took it wrong

many of us going thru Casa know K1 is rarely really rarely granted

many do no join VJ but there are thousands (now ) from morocco seeking a K1 visa and look please at the stats of the approved

17 in an years time is poor

i was not really judging but your income and a K1 are a poor case

i gave a lot of good advice like "go and marry"

and i just helped 2 moroccans from here get visas after over a year in AP

and one from Ghana go thru an appeal

this is not an easy embassy

i did wish you good luck

don't bite a hand that tries to help

i told you to strength your case and position
