So my lawyer used an old I129f form...

Usually it takes a few weeks to be rejected and returned. my thoughts to you is as I've seen and heard immigration lawyers mess things up most of the time. Save yourself time and money and do it yourself since it's a basic form that doesn't need a lawyer to fill.

Visa Class: IR-1.

Country: Jordan.

Embassy: U.S embassy in Amman, Jordan.

Married: May 28, 2015.

Interview Date: Aug 17, 2017.

Interview Result: Approved.

VISA Received: Aug 21, 2017.

U.S Entry & Passport Stamp: Aug 25, 2017.

Permanent (Green) Card was produced: Oct 9, 2017.

Permanent (Green) Card was mailed to me: Oct 11, 2017.

Received My Social Security Card: Oct 29, 2017.

First Job in America: Dec 21, 2017.

Received Plastic Green Card in the mail (Permanent Resident Card): Mar 16, 2018.

N-400 Applied: May 28, 2020.

N-400 NOA: June 1, 2020.

Bio: June 19, 2021.

Interview: July 23, 2021.

Ceremony: Aug 13, 2021.

You will receive the entire packet as is withins two weeks of sent date. Just replace the form and you would have only lost weeks rather than months. While you are at it, you may consider CR1 if you could marry away. I find it a much better visa and worth your money and time, especially if a lawyer is involved. Furthermore, I am not sure why one needs a lawyer for either K1 or CR-1. Good Luck!

Thank you all for your responses.  We are devastated from this delay and we are hoping that it gets returned this week so we can send it back out.  If I could turn back the clock I would.

 

Does anyone know if they send a notice or email for the rejection?  Or do they just send the package back silently?  Should I call USCIS to see?

@Derik-Lina  Thank you for your post and comment.  Within two weeks will align with my lawyers timeline for the return of the package.  That makes me hopeful that we can send it back out with minimal delay.

You will habe a giant stamp on the form: REJECTED.......... Do not panic!

It only means the application can not be processed with the wrong I129 F form.

Thank you so much, your words have been very comforting in our current dark time.  I know this will be a rough ride and wait but this delay is something that I couldn't have imagined would happen to us.

Sorry, you need to slow way down and learn about the process, before you make any more mistakes.

 

For starters, there is absolutely no need for any middlemen between you and the federal government in the I129f process.

Immigration lawyers are good for exceptional cases where criminal backgrounds or complicated immigration histories come into play. For a straight-forward K-1, you can do it all yourself. We had someone in the removal of conditions forum get an RFE even though he used a lawyer and the lawyer wanted another $1000 to fix it. In my opinion, the lawyer did this on purpose.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

I would fire that lawyer.

 

If they're making that kind of elementary mistake, who knows what other kinds of non-elementary mistakes they are also making.

Exactly my thought. This lawyer showed incompetence and a lack of attention to detail.
