So my lawyer used an old I129f form...

Timeline

Hi VJ community,

 

My lawyer used a I-129f form from 2016.  I’m certain it will be rejected but how long will it take to get back to my lawyer?  We sent it out in 4/6.  The lawyer is saying it should be back this week... is that unrealistic?  I didn’t get anything via email or text and my credit card wasn’t charged as of yet.

Is he an immigration lawyer? Because that’s a big miss.

it may delay your application for weeks, for no reason at all now.  it's so easy to just download the current one when you go to the website and have the most up to date form. as i understand, when you use the wrong form or prior forms, they reject the whole packet and you have to refile by snail mail.

10/17/2018                After 136 days of wait in HELL, finally EAD in production

10/21/2018                Card was mailed to me, and yes it said so on a Sunday night, while Vj-ing

10/22/2018                Card was picked up by the USPS

10/24/2018                EAD in hand. F%^&& finally

12/28/2018                Interview has been scheduled. Waiting for notification with date by snail mail

Thanks for the reply, she blames a software subscription  which she uses that supposed to give her the proper forms.

But yeah...that's a pretty major mistake. is there a particular reason you are using a lawyer at this stage? The I-129F is a fairly basic form...in many cases, you're more likely to have something getting mistaken during relaying it to a 3rd party than just filling out the form yourself.

 

Thank you for your response.  We actually hired this lawyer to help us avoid mistakes and the fact that they can translate in house because we’re both divorced and her divorce paper requires translations.

 

I was hoping the lawyer would be correct regarding the timeframe but I am not surprised.  I didn’t get any notification but I thought I’m supposed to get a rejection email or something?

IMO you should maybe finish with this lawyer service after the K1 process is done. That is being highly incompetent that he blamed it on some software. Thousands of people file on their own and don't make these mistakes.

U can just ask here, there are a lot of guides in this website that are really helpful! Also a tons of experienced people here! and regarding to translations, there are a lot websites that are USCIS approved.. and it's online between 24-48 hours ...

04/04/18  - Mailed I-129F

04/06/18 -  NOA1 notice date email/text

10/18/18 -  RFE notification

10/22/18 -  RFE received in mail

11/01/18 -  RFE sent to USCIS

11/06/18 -  RFE received by USCIS

11/14/18 -  NOA2

11/27/18 - NVC Received

12/12/18 - NVC Case number

01/8/19 - Scheduled interview-APPROVED

01/21/19 - POE!

OP,  I would kick that attorney where the sun don't shine but that is me. I understand if you need the extra services they offer you (translation, etc) but if they start their job with this kind of mistakes I would not sleep at night and I would demand some sort of refund.  That is just me. You can do this on your own next time. When I needed something translated I did it myself. My hubby and I were able to do all the immigration path (from K1 to citizenship) using the help on this site.

I have been on VJ for a while and found this is the common conception when people decide to use lawyers. At the same time I have come across equal amount of threads where the lawyer, or people working for the lawyer, made mistakes. I remember one poster that shared that after a few weeks of not hearing anything they found out the lawyer had not yet sent their package out. The lawyer blamed being backlogged with cases. 

 

The K1 visa is pretty straight forward and all the tools you need are on this site. I agree that you should look into doing it yourself as an option.

Lawyers can do things to cause issues or delays so more money can be made off their clients. 

 

I subscribe to a monthly lawyer plan through my work where legal fee for K-1 is covered with zero deductibles.  However, I still filed my K-1 by myself since for this simple form, I trust myself more than any other third party.  

 

I suggest get your money back and file for yourself once you get the form rejection notice by yourself or through your lawyer.

07/27/17 - K1 packet sent at the end of day.

07/31/17 - NOA1

03/22/18 - NOA2

08/28/18 - expected date for medical completion - Sputum test was needed

09/22/18 - anticipated interview date
