To Appeal or To File a New CR1--That is the question....

One lawyer says appeal (for several thousand dollars and takes time for an answer), the other one says file a new CR1 and answer the appeal within the divorce papers section. OMG, I feel like can't escape this living ####. Money or health...which will be the first to go? If we lose the appeal, more time wasted, and we have to start another CR1 anyway. If we don't file the appeal, will they feel like we didn't bother to fight? (Although we filed a rebuttal.)

 

Does anybody know how long an appeal can take?

 

Nobody deserves what immigration authorities do to people. (Please God, give us the strength to keep going....)

I'm so sorry for your situation. In my humble opinion I think you should file a new case. Because if u lose the appeal u will have do apply again anyway. And if u filed a rebuttal, then don't worry that they think you didn't fight *what ever you do don't lose hope*  good luck

Thank you so much for the encouragement! I am going back to the lawyer tomorrow. I am going to tell him that instead of filing an appeal, I want him to prepare an affidavit confirming the fact that my husband WAS divorced when he married me, and there were two legal papers sitting in the paperwork at his so-called interview to prove it to include in our new CR1.  The CO's  are the ones that lied to harass and intimidate my husband. We have no "proof" because they don't tape the interviews...gee, I wonder why (sarcasm). My husband's doctor knows how he has suffered since the "interview" because he has suffered a lot of physical ailments since then that he never had before.  I' m sure we have a target on our backs, but God knows the truth, and you can't do better than that! You can bet we won't stop fighting! My husband is applying for jobs in countries closer to the US so that I won't have so far to fly to visit. This will be a fight until the end, no matter what! We won't give up, and we won't go away. But we WILL stay together, even if the CO's say ugly things about us. They had no reason to deny us, so they had to make up lies and use tactics NOT approved by the USCIS. We can go to sleep at night with a clear conscience.
