Dear all,

 

Please help me as I am all confused and bit stressing out.

My K1 visa has been filed by my fiance in march this year and at the same time i came to knew that my employer where i work is also filing my H1B visa.

so I would like to know , will there be any problems because of two visa filed at same time??

and what i need to do now, how am i suppose to be getting married to my fiance ?

Multiple petitions, sure.  Not so sure about multiple visas.  

 

At the moment @PreetiKaren is in the petition stage (with USCIS).  Once the petitions are approved and forwarded to the NVC you can apply for the actual visa.  I'm not sure you even can apply for multiple visas, but also that wouldn't make any sense to me.  I'd suggest to go for one visa (H1B), with the other (K1) as the backup option.

Of course you can have multiple visa's, many do.

 

OP has not mentioned what type of H1b, maybe subject to the lottery.

 

If you go with both and one fails then you have the other one still running.

actually my company in which I work is applying for my cap exempt H1B visa (which is valid still as I got that in 2012 and its valid for 6 years), because many employee are getting H1b rejected these times, so management of our company is making sure that those employees who already have H1B , can go for renewal. Now here I am not sure if my H1B cap exempt visa will be processed successfully or not, what if it got rejected and after that if i will go for K1 visa, it might not appear to USCIS that I am desperate to be in US anyhow.So i am worried abt that , tht it may not impact my K1 Visa process in any way. I am getting stressed out IDK why i jus cant think of living away from my fiance in any way. :(

marry and adjust as in? I need to be thr in US first and thts wat I m worried abt wat if H1b got rejected during stamping process, its happening a lot here these days.

so thts what my question is wat if H1b got rejected and then in K1 process they came to knew abt it and think that I am being desperate . i jus wana know if H1b rejection will impact my k1 in short?

Perhaps you could ask you Fiance to post as there are obviously language issues.

What he is saying is that the way you made it sound like is your already here on the H1B visa and your company is trying to extend it. So if your out of the country trying to get a new H1b and a K1 then yes it is ok to have 2 petitions open at the same time and happens a lot actually.

 

Yes, the H1b visas are being looked at more strenuously now than back in 2012 because of companies using them to get around the system so to speak. What is actual job skill that you think would be exempt from the cap limit? Just be prepared because you may get denied for the H1b visa to come here to the USA.

Probably not.  They're anyway assuming that you're desperate to come to the US.  For K1 you need solid documentation that your fiancée and you have a genuine relationship.  Then you should be fine.  (Although it also depends on what country you're from.  Some consulates are very fussy and reject a lot of K1 applications.)
