i live in canada...my partner is in vermont...once he files the 1rst set of papers..k-i....do i have to stay in canada, or can i still go over to visit him?

Some people have come over to visit and had no problems - others have been denied because the system showed they had applied for K1. You can take a chance if you feel like it but be prepared to go back as that has happened to some. Why not let the USC visit you? Good Luck

It is a judgement call-some have tried with success, some have failed. I think if you can show that you will be going home after your trip you will be ok(it all depends on the officer). Have copies of leases, utility bills, car loan statement, letter from employer-anything that will prove you will be going home after your visit.

Even with all that evidence they have the right to deny you entry

I visited my fiance several times while our K-1 was being processed, with no problems.

I entered the US from Canada by car, not plane or train, and the border officers would ask me the purpose of my trip, and I would tell them to visit my boyfriend. They would sometimes ask if I had heard of the K-1 Visa, and I would tell them we have applied and are awaiting approval.

As long as I could show proof of ties to Canada, such as lease/mortgage papers, recent pay stubs, etc. as proof that I was intending to return to Canada after my "visit", they seemed okay with it.

There is never any guarantee, though, that they will allow you to enter, but if you go prepared to show ties to Canada, your chances will be better. Don't provide the border officers with too much information, just answer their questions honestly.
