Could someone please help clear something up for me. I am filing form I-485 (AOS) with form I-765 (work authorization). On the work authorization form, it says to mail it to Nebraska if you are sending form I-845, I-765 and I-140. What is the I-140, and do I send the I-485 and I-765 to Nebraska or Chicago? Please help me! I would like to send it out today, so any help would be great! Thanks!

May 2, 2006- Sent I-129F to Nebraska

May 5, 2006-NOA1

June 1, 2006-Transferred to CSC

June 14, 2006-Received letter confirming transfer

June 15, 2006-Touch!

June 16, 2006-Touch!

June 17, 2006-Touch!

June 30, 2006-Received RFE!

June 30, 2006-mailed RFE to CSC (overnight)

July 3, 2006-Touch!

July 4, 2006-Touch!

July 5, 2006-CSC received RFE

July 6, 2006-Received email confirming CSC received RFE

July 27, 2006-Touch!

July 31, 2006-Approval!!!!!!!!!!!!!!! (SOOOOOOOO EXCITED)

August 1, 2006- Email stating we had been approved!

August 1, 2006- worried about what comes next!

August 7, 2006-package sent to NVC

August 8-17-package was received by NVC, processed, and sent to London Embassy

August 17, 2006-Rich received packet 3 from the Embassy in London

August 22, 2006-Rich mails packet 3 back to London Embassy

August 31, 2006-Rich has his medical

September 21, 2006- I received an email from the Consulate with the Interview date

September 23, 2006- Rich received Packet 4

October 18, 2006- Interview! Approved!!!!!!!!!!!

October 20, 2006- Recieved visa in the mail

May 04, 2007-Sent AOS and EAD packets

May 09, 2007-NOA1

June 01, 2007-Biometrics appt.

June 12, 2007-AOS transferred to California

July 16, 2007-Touch (AOS)

July 17, 2007-Tourch (AOS)

July 18, 2007-EAD approved!!!!!!!!

July 27, 2007-EAD arrives in mail

September 05, 2007-Green card arrives in mail

Immigrant Petition for Alien Worker I-140 If that's you then yes you would file it from your timeline looks like it's not though... so no you wouldn't file form I-140

As the above poster stated...if you are adjusting from an employment based visa then yes, you fill out the I-140. Is that the type visa you came into the States with? Marriage based visas do not need that particular form. I-485, I-765, and the I-131 (advanced parole) if you want to leave the country while your AOS is pending.

Not quite. People adjusting through marriage to a US citizen from an employment based visa would file I-130.

That I-140 is only for people getting green cards through their employers.

Yes, that I know...but I didn't know that if you come on an employment based visa and then get married that you have to adjust status according to the employment based visa rather than AOS due to marriage. Or did I just confuse you?

Sorry, I think I must have confused you! If you came here on a employment visa (e.g. an H-1B) then you can adjust status in any way which is appropriate to your situation. If you marry a US citizen, you can do the AOS process like anyone else here on a K-1 would, apart from the fact that your USC sponsor has to file I-130 on your behalf.

My 2 cents: I-140 is filed by the employer, who is sponsoring the employee on a work visa for a green card. It's not filed by the employee him/herself. The only exception is "extraordinary ability" - if you're extremely talented and recognized worldwide, you can file I-140 yourself :)

Sorry, I think I must have confused you! If you came here on a employment visa (e.g. an H-1B) then you can adjust status in any way which is appropriate to your situation. If you marry a US citizen, you can do the AOS process like anyone else here on a K-1 would, apart from the fact that your USC sponsor has to file I-130 on your behalf.
