Hello everyone!

On Sept 29, 2017, we've filled for an Adjustment of Status after entering on a K1 visa. After 195 days of waiting they've sent us an RFE letter with those bullet points:

 

  • The "Sponsor's Household Size" on the petitioner/sponsor's form I-864, Affidavit of Support (revision date 07/02/2015), was calculated incorrectly or not completed. A household size of 0 or 1 is not acceptable. The petitioner/sponsor must correct and/or complete and return Page 4 of Form I-864.

 

  • Based on the documents submitted with Form I-864, Affidavit of Support, for the joint sponsor, the income did not meet the 125% of the poverty guideline for the joint sponsor household size. Submit evidence of assets that meet the standards listed below or obtain a different joint sponsor.

If you decide to obtain a joint sponsor they will need:

  • File Form I-864, Affidavit of Support (revision date 07/02/2015)
  • Provide copies of their most recent Federal income tax returns
  • Provide copies of all supporting tax documents (W-2's, 1099's, Form 2555 and tax schedules)
  • Provide evidence of their status as a United States citizens, United States National, or Lawful Permanent Resident.

 

Although it's pretty clear what they're asking for, I still have some questions (we can never be too sure)

1- When initially filling the form i-864,  the joint sponsor used his then recent, 2016 income as "Individual Annual Income". The question is: Can my joint sponsor use his 2017 Tax returns Information or simply goes with the prior one?

 

2- The form I-864 has been updated since then. The current version on the uscis website is dated 03/06/2018. That means the 07/02/2015 has been expired and no longer available for download. Should we ignore the fact that they are specifically asking for the 07/02/2015 and just go for the new one?

 

3- The joint sponsor agrees to combine his household income in order the meet the 125% poverty guideline, which he didn't do when he was first filling the form. Isn't it safer to just resubmit the whole form I-864 (with the new revision date) and not just the page 4 asked? Since this change will also have an impact on other pages of the form?

 

I know it's a lot to ask and my questions are kinda confusing, but we've been waiting for so long, I really want to do my best to get everything right. If anyone has experienced this situation or has an idea please let me know.

Hello I am only familiar with the household size, if it is just you and your husband and you do not have any kids yet, it should be as followed:

Box 1: 1

Box 2: 1

Box 3 to 7: 0

Box 8: 2

 

This is what we put on our forms and it was accepted

02/09/201: Received Biometrics Appointment Letter scheduled for 02/22

02/10/2018: Email notification of RFIE :(

02/12/2018: Early walk-in for Biometrics, successful

02/16/2018: RFIE received for birth certificate and translation, sent back the same day

02/20/2018: RFIE response delivered, sent via Fedex

02/23/2018: Case status updated to RFIE response received

03/05/2018: Courtesy letter for I-693, medical exam received, letter dated Feb 28th

03/08/2018: AP application delivered by Fedex

03/19/2018: NOA for AP received in the mailbox

05/03/2018: AP ONLY approved (Approved in 56 days)

05/11/2018: AP received in Mail

05/21/2018: Email received,EAD card in production (Day 133)

05/22/2018: Interview scheduled

05/25/2018: EAD approval letter received in Mail

05/29/2018: EAD card and letter for interview (Jun.26th) both received in Mail, Woot woot :)

06/26/2018: Interview completed, now waiting for the magical email/letter...

10/30/2018: Went to Infopass, officer has not made a decision yet, an email was sent to him tell him I came to inquire

03/26/2019: Moved so updated our address online with USCIS

04/16/2019: I-130 petition approved

04/20/2019: approval notice received in the mail

04/22/2019: received notification of RFE for AOS I-485

06/01/2019: RFE finally received after being lost in the mail, asking for a new medical exam

06/06/2019: Response to RFE sent, received the next day 06/07/2019

06/17/2019: Received notification of another RFE, 3rd time will be the charm hopefully

06/22/2019: RFE received for new medical

07/02/2019: Went to doctor for new medical

07/11/2019: I-485 approved without new medical exam

07/18/2019: Green Card received in mail

03/16/2018 - Received RFIE dated 3/12/2018 (For I-864)

03/19/2018 - Biometrics done 

03/22/2018 - Mailed RFIE response package via USPS Priority Mail Express

03/24/2018 - USCIS received RFIE package

03/26/2018 - USCIS notification that they have received RFIE (case is no longer on hold)

04/04/2018 - Biometrics has been reviewed

06/19/2018 - Case is ready to be scheduled for an interview (online notice)

09/08/2018 - EAD/AP approval notice received in the mail (Notice Date - 9/4/2018)

09/20/2018 - EAD/AP card being produced (online notice)

09/27/2018 - EAD/AP card arrived in the mail

05/17/2019 - Notice for interview received (Interview date - 06/24/2019)

06/24/2019 - Interview at New York Office (Federal Plaza)

06/26/2019 - New card being produced (online notice)
