Hello, 

 

I apologize if this information is already on here but I couldn’t find it. I am the fiancé of a US citizen and we are trying to complete to I 134. I have a baby with my fiancé and he has 2 children from a previous relationship and he shares 50/50 custody with their mother (there is no formal court order they came up with this arrangement themselves if that’s relevant). Am I correct in thinking that for dependents I should list his 2 children as “partially dependent” and then our daughter as “wholly dependent”? Because technically, he is not yet fully supporting her as I am able to do so here in Canada. He will be when we move to the US. We do not have a K2 for her as we obtained her CRBA and she is dual. Do I list her because she’s his child even though she’s is not yet a dependent? Him and his ex each claim one child on their tax return, so his dependent section on his tax return will only show one child. So confusing. Also, are we to report the income on line 22? He is self employed. Thanks for any and all information. I’m lost.
