Known cases of I-864 being brought against sponsor by Government?

I was the sponsor of a now USC. As you know the way the ACA is set up it’s almost impossible to not be put on Medicaid if you qualify. The family member I was a sponsor of qualified for Medicaid due to being an LPR for more than 5 years. I do not understand why this is allowed if the sponsor may have to pick up the tab eventually. So now that the said individual is a USC, would they have to pay? How often does the government come after sponsors for repayment of Medicaid?

If they are a USC no sponsorship applies.

 

PS in some locations you can get Medicaid from day1.

It is "allowed" because the 864 in round about terms states you will help support the immigrant to keep them above the poverty level. If they qualified for medicaid they have extraordinarily low income. So one could argue you did not help support them at a sufficient level. 

 

Anyway- it is extremely rare that the gov comes after sponsors. I believe in history it has only happened 2-3 times. Not to 2-3 people but 2-3 times they attempted to collect from known sponsors that owe. It turned out it cost the gov more money then they were able to collect. Occasionally you will hear politicians talk about attempting to collect it once again but its just campaign/policy talk and goes no where. Until they come up with a more efficient system to collect they probably wont try it again. Its currently not an issue you should be losing sleep over.

Rarely if ever because Medicaid is a joint run program vs Medicare a federal program.  The affidavit is not in effect for any of the state run benefits .  This is why qualifications, waiting periods & benefit levels vary greatly from state to state
