Bringing future wife - permanent resident

Hi,

 

I have a question and hopefully somebody would be able to give me some advices.

 

i am a green card holder and planning to get married this year, then I will not process my wife green card.

she is planning to take a master in US, then while she does Hermanto master here I will then process Hermanto green card. Will that against immigration policy?

If she intends to enter on an F-1/J-1 visa and then apply for AOS (apply for a green card) while in the US, then that would be visa fraud. She is permitted to enter on those visas, but she would still need to intent to interview abroad for the immigrant visa (once the I-130's PD is current).

 

As an LPR, she can't obtain an immigrant visa (or complete AOS within the US) until her Priority Date (PD) is current. You would file an I-130 for her and then wait for that to be approved and the PD to be current. For a spouse of an LPR, it's about a 2 year wait right now.

 

If you obtained your green card through a former spouse, the wait is 5 years from when you got your green card before you can petition a new spouse (without having to overcome a presumption of fraud).
