Hello everyone, I am new here and I badly need help. For the last few days I've been researching and gathering information about filing the K-1 Fiance Visa. Please take time to read all the requirements I compile and tell me if I missed something or this specific requirement/s are not needed in filing. Please take note that I include everything, even RFE evidences that they might need.

You don't need MUCH of this stuff until the embassy / interview stage. Do not send this many documents in your initial filing.

One question since it's a bit confusing.....

 

How does he have a US citizen birth certificate AND a US Naturalization certificate?

If you meant he was born in a foreign country and later on became naturalized, then include the copy of the naturalization certificate.

My mistake there sir. My Fiance has no US Naturalization certificate.

  • Birth certificate of beneficiary is not necessary.
  • CENOMAR of beneficiary is not used at this stage (and a new one will be needed for the interview anyway).
  • The petitioner only needs to send a copy of one the following: their BC (if born in the US), US passport, OR naturalization certificate. Any of these will show meeting the requirement of being a USC.
  • Passport copies are not required (except if using it as proof of being a USC, as noted above). The beneficairy's passport is not needed.
    • You can include this to show passport stamps as evidence of meeting within 2 years, though.
  • Letters of intent to marry should be signed.
  • Declaration of how you met is fine, assuming the space on the I-129F is insufficient. In most cases, the space is sufficient.
  • Proof of meeting in person is a big one for RFEs...what exactly did you send for this?
  • I-134, pay stubs, tax returns, W-2s, evidence of income, bank statements, etc. are not looked at for the I-129F. They cannot issue an RFE for this...it is only presented with the I-134 at the embassy stage (and will be long outdated by the time it gets there).
  • I don't suggest sending a photo album. If you want to front-load, just send a reasonable number of photos/chats/etc.

Hi everyone, I am Velvolt's Fiancé.

Geowrian, in the petition I basically put that I went on vacation and stayed with her, I assume thats sufficient for the statement of having met.

As to proof of meeting, are a few pictures, my passport stamps, hotel receipts, and flight tickets enough?

How many chats should we put for how we met online? She intends to do a bunch of scrapbook/files, which I didn't know were necessary. Is she on the right track?

Yup, that'll do fine for how you met.

Nobody can say for certain what will be enough, but those are the commonly provided items that tend to do the trick. :) Basically, look at it from the perspective of somebody that has never met either of you...is there a reasonable way they could believe you did not see each other in person given the evidence provided?

Nothing overboard is needed...I went very light personally, but several photos + like 1 page of chats for each month together is usually more than sufficient for front-loading. Don't go overboard (people have sent in 500+ pages of chats and photo albums and such...).

 

If you first met through a website, it's probably a good idea to send evidence that the website is not an IMB (i.e. the site's TOS, privacy policy, first messages if you have them, etc.). Other choose not to mention the website (you aren't required to mention your first contact...just meeting in person within the past 2 years) and not address the IMB evidence as a result. It seems to be effective, although I personally subscribe to the idea of providing the information + evidence anyway.

 

The main thing is to bring the relationship evidence to the interview. Front-loading is just to set a good first impression....COs in some very difficult countries are suspected of making a decision before the interview. Since you (err, your fiance) mentioned a CENOMAR, I'm assuming you will interview in Manila...correct? If so, you don't have much to worry about with relationship evidence for the K-1 visa...they are pretty lenient. Be prepared and show your case, but try not to worry too much either.

Thank you very much for all the information! I am sure she will greatly appreciate it when she wakes up! Yes, she will be interviewing in Manila. 

We actually initially met through an online game we used to play, imagine that! Lol. Then stopped talking, and started talking again about a year ago. I think we will mention the game, send in a few initial facebook chats as well.. then skip to the more recent chatting from the last year or so as well as the visit!

One final double check on my part. For the initial send in packet on the petitioner side I need to send -

Form I-129F with supporting evidence of how we met & my visit in person.

No problem. Ah, "she", sorry. Then yes, she should be fine. :)

It's not as uncommon as you may think. haha There's a number of people on VJ that met through an online game. If you do mention it, I do suggest including the TOS and/or EULA just in case. The facebook chats are fine to include as well.

 

As for the list, it looks alright. The cover letter should still be included, though. I would compare the list to the guide (http://www.visajourney.com/content/k1guide) as well, but it looks good assuming there's no divorces, name changes, or criminal/arrest record documents that need to be provided.

 

The passport photos can be scanned, but need to meet the US passport photo requirements when printed and included in the packet. I personally printed 2 of them on a 4"x6" (printed at a local Walgreens) and cut them into two 2"x2"s by hand. Cost: ~$0.50. Others prefer to pay the actual passport-sized photo fee for piece of mind. Just be sure they meet the requirements with regards to head position, ears showing, etc. These do need to be on glossy paper (typical photo paper is fine).

Exact requirements for reference:

"You must submit one color passport-style photograph of yourself and one color passport-style photograph of the beneficiary taken within 30 days of filing this petition. The photos must have a white to off-white background, be printed on thin paper with a glossy finish, and be unmounted and unretouched.

 

The color passport-style photos must be 2 by 2 inches. The photos must be in color with full face, frontal view on a white to off-white background. Head height should measure 1 to 1 3/8 inches from top of hair to bottom of chin, and eye height is between 1 1/8 to 1 3/8 inches from bottom of photo.

Your head must be bare unless you are wearing headwear as required by a religious denomination of which you are a member  Using a pencil or felt pen, lightly print your name and A-Number (if any) on the back of the photo."

 

Any non-passport photos can be scanned and printed anyway you want. Color is probably for the best, but they don't need to be professional done or anything. I chose to have them printed at Walgreens as well, but others printed their own on their home printer. It doesn't matter so long as they are readable...these are supporting evidence which doesn't have any special requirements like the passport photos.
